Both sides in James “James Freeman” Springer’s (Freeman) lawsuit versus New Mexico’s Seven District Court were ordered to appear on March 13, 2024, to engage in a settlement coverage.
The lawsuit was assigned to Magistrate Judge Jennifer M. Rozzoni who ordered the lead counsel for each side to appear in person on the March court date in order to move forward with the settlement conference.
Freeman has until February 21, 2024, and the defense has until February 28, 2024, to exchange demands and to see if they can come to an agreement to settle the case. Freeman’s representative would then send the Judge copies of the exchanged communication by March 6, 2024.
Both sides then have until March 6 to send the Judge direct confidential letters providing a brief summary of the facts, analysis of applicable law, and an outline of relief requested and the status of settlement negotiations.
From there, the judge may set an ex parte pre-settlement telephone conferences with both counsels to obtain additional information to assist in her efforts to facilitate the settlement.
The lawsuit was filed by Freeman in June of 2023 after he was banned from courthouses in the Seventh District without having a police escort during the visit. Freeman has continued to protest at the Torrance County Courthouse to express his displeasure with the order during the lawsuit, using his tremendous fandom to voice their mutual displeasure towards Court staff.
Freeman is seeking a Declaratory Judgment stating that the enforcement of the administrative orders was unconstitutional along with a statement that employees violated his rights. He is also seeking an award or damages and a permanent injunction prohibiting the defendants from enforcing any administrative orders limiting his access to public spaces or public hearings without first affording him due process of law.
