Attorney Mark D. Zuckerman, writing on behalf of the New York Police Department, requested multiple deadline delays in SeanPaul “Long Island Audit” Reyes’ (LIA) lawsuit against them due to LIA’s pending amended complaint.
LIA’s attorney, Andrew Case, posted a notice on Wednesday that he would be filing an amended complaint before the amended complaint deadline on January 22, 2024. This was a day after Zuckerman filed for summary judgement in the case.
According to Zuckerman, due to the pending filing of the amended complaint, the January 18, 2024, deadline to tell the Judge if the NYPD would pursue a request for a trial no longer would work as they would not have time to see the amended complaint before making their decision.
Zuckerman explained that with the previous complaint, they were inclined not to pursue a trial. As they haven’t seen the amended complaint, Zuckerman is asking for a delay of January 29, 2024, to inform the court if the NYPD would be seeking a trial.
Similarly, Zuckerman has asked for a delay until February 8, 2024, to provide initial disclosures to the Court. Currently, they’re due on January 18, and would have to be made before the amended complaint possibly is even filed.
Lastly, Zuckerman is seeking a February 15, 2024, deadline for initial discovery demands (moved from February 3, 2024), again due to the pending amended complaint.
