Jailed YouTuber, activist, internet lawyer, award seeking journalist, bicycle enthusiast, snappy dresser, budding DJ, future Green Party candidate and all around swell guy Lane Myers rages in an audio statement released by the Illuminate the Dark YouTube channel Friday night after a follower named Joey Payne was denied audio of his July 23 hearing while Illuminate the Dark called for call flooding of the Judge in the case.
Myers stated:
“Hey Judge Metcalf, it’s time for you to be a man of your word. You stood there in open court last week. Uh what was it? the twenty third and you said the court audio would be recorded and available for purchase from the court reporter, which is why you were denying Mark Brown and those others from being able to record the hearing because you said, Don’t worry, it will be available from the court reporters. And Lane Myers stood up and said, Hey, Your Honor, there’s a guy transcribing this right now and I don’t want to hear no bullshit ass games about how, oh well there was a guy typing so there was no audio. You looked me straight in the face and said The audio is being recorded, the transcripts are something else. I said, I didn’t I know, but I’m worried because whenever there’s somebody typing, they make you pay for the transcript instead, and I had to pay nine hundred dollars for a transcript of a one hour hearing and you told me, don’t worry, the transcript was something different.
The audio is gonna be re the FTR audio will be available from the court for purchase. Rachel even made a big deal about, well, they’ve already got the audio to the hearing and they’re posting it all over YouTube. So now it’s time to be a man of your word and stop gaslighting the people. and telling us one thing and doing another while sitting up there on your high horse, you specifically said the audio will be available. We specifically argued to make sure the audio would be available even though there was a transcriber. You said in open court on the record, the audio will be available. Now they’re being told the audio is not available and you can only order the transcript. So now you need to put on your magic wand and say Court order, make the audio available, just like I said in court. Otherwise, Metcalf, your word is no good. We already know your word is no good. But now you’re just proving it over and over that you say and do things on that up on that judge’s bench that are not ethical. You literally said in open court, no recording allowed because we’re recording. Rachel agreed to that. We uh Resnick and Lane Myers agreed to that. Okay, well then if the audio is gonna be available from the court Then that’s a and Rachel even said, Yeah, I like when it’s better for the court to have the audio because they only record certain things. They don’t point the camera at the victim. So now you’re gonna get to understand what it’s like to be a liar in a black suit”
Illuminate the Dark then posted Judge D. Douglas Metcalf’s phone number and e-mail address with a directive to her followers to “give Metcalf something to work on Monday morning! Let him know we want audio, not transcripts”.
This was accompanied by a message to a user named “Joey Paine” stating that the court reporter was present at the hearing therefore audio was not going to be released along with contact information for the reporter for purchase of a transcript.
It is unclear what the Judge can do in this instance, as it is long standing Pima County policy not to release audio recordings of the hearing when a court reporter was present at a hearing.
ReallyCoolNews encountered this problem last year when we attempted to purchase the audio of Myers’ change of plea hearing. Since a court reporter was present, the audio was not available for purchase. We paid $164.50 for the transcript then presented a dramatic reading of the hearing on our near nightly audio stream.
Myers received more bad news Saturday morning as the enormous windfall to his GiveSendGo account apparently ended on Friday as he received no donations for Saturday’s take.
The fund for Luis “Real Constitutional Upholders” brought in $50.00 to win the crowd sourcing race for Saturday. No other campaigns that we follow saw donations for the day.
