A batch of new twists came in for the Lane Myers Experience on Thursday as Lane Myers received significant new donations to his GiveSendGo account following his interview with Blue Line Transparency, an Arizona Superior Court judge ruled against outside recordings of future proceedings and Myers’s attorney, Mark “The Shark” Resnick filed a new motion to dismiss the proceedings based on what he claims to be lack of evidence presented by the prosecution in the case.
Starting with the financial windfall. Myers brought in $430.00 to his GiveSendGo account to win the crowd sourcing title for the day following his interview with YouTuber Blue Line Transparency. He was followed by Roy Tripolini’s fund for James “James Freeman” Springer, which brought in $50.00 in new donations, Jose “Chille” DeCastro who brought in $40.00 to his Help Me Defend My Constitutional Rights fund, and $10.00 to the fund for Angel “Kansas City Accountability” Moses.
The controversial interview saw Myers apparently admit to openly distorting facts about his case in his previous interviews last year in order to gain media attention and revealed that he needed money to appeal a future ruling to revoke his probation should it happen.
He asked Blue Line Transparency to get the word out to other major YouTubers as he needed to put pressure on the prosecution and the judge to either drop the accusations that he violated his probation or greatly reduce the punishments he’ll receive if found to have violated said probation.
Myers went so far as to apologize to YouTube darling and budding hate monger Jose “Chille” DeCastro, who he said needed to stop talking about himself and take up Myers’ cause.
Later in the day, Myers’ attorney, Mark Resnick attacked the prosecution’s case against the jailed YouTube bicycling enthusiast by complaining that the state provided him with 80-100 hours of footage and had poorly noted the instances where it alleged that Myers had violated his probation.
Resnick wrote:
WHEREFORE, in the instant case, the charges are so vague the defendant cannot defend against those charges. He cannot divine on his own which statements the state alleges to be a violation that runs afoul of the probation condition at issue. There is a single count, yet numerous statements alleged. In fact, there are criminal statements alleged which are not recited in the disclosure at all.
Accordingly, the petition should be dismissed, or in the alternative, a bill of particulars should be granted to provide sufficient notice of the facts and conduct that were determined by the State to be sufficient to charge the Defendant. It should be of no burden to the state to come forward with this information. They must have it in their possession, for the defendant cannot believe the state would ever have filed unsupported and untested allegations with this court.
Late in the afternoon, all parties convened for what was set to be a hearing to handle two media requests that had been filed, seeking to audio and video record next week’s hearing for oral arguments on Myers’ motion to modify his bond conditions.
Mark Brown of Arizona United News and Mark Dickinson of Mark Dickinson Photography submitted media requests to record Myers’ July 28 hearing for his Motion to Modify Conditions of Probation.
With Brown present in the courtroom and Dickinson failing to show, Judge D. Douglas Metcalf ruled against audio and video recording of all future proceedings in the case.
For his reasoning in denying the requests, he stated that the victim in the case was against recording, there was no way for the Court to control what was recorded, the availability of transcripts and the Court’s own audio recording to the public, the need to keep confidential materials confidential, and the preservation of the dignity of the court.
The news of Metcalf’s decision brought about an immediate response from Josh “This is a Public Service” Grey, who posted on his YouTube channel, a quote from Thom Ryder stating, “Every boot you ignore stomping someone else’s neck is just breaking in the leather for yours.”
Other fans chimed in, indicating a desire by Grey or supporter Illuminate the Dark, to hire their own stenographer to be present in the courtroom as, “Maybe there’s enough money raised to hire Lanes own stenographer to keep the record. Can’t trust theirs.”
Back at the proceedings, according to our court reporter, JudyYouGotThis, Judge Metcalf ruled that Myers will present his motion to have his probation conditions reduced at next week’s hearing. Metcalf indicated that attorney Resnick would have to completely rewrite the motion in order to present said motion.
Judge Metcalf held and extended Faretta hearing in order to advise Myers of his rights when serving as his own council and to appoint Resnick as his standby council during the matters. Prosecutor Rachel Stiles called the mixed proceedings unusual and Myers himself delayed the hearing by using sarcastic answers to the judge’s questions, requiring the judge to repeat a good portion of the required questions.
Metcalf also ruled that there was no gag order on Myers from talking about the case, as long as Myers abided by the probation guidelines. Myers reportedly stated that there was significant media interest in the case and that if he violated probation guidelines, he should be charged with those violations.
Finally, in a brief discussion about Resnick’s motion to dismiss, Stiles indicated that most of the complaints by Resnick could have been handled if he hadn’t skipped a meeting that had been scheduled with her.
Resnick complained that he had three people going through the 100 hours of footage and that the key provided to Resnick was insufficient in helping him determine what the prosecution was alleging.
Styles and Resnick will apparently meet on Tuesday in order to go over Resnick’s motion.
