In perhaps the saddest moment of what has become the Lane Myers Experience, non-party participant in Myers’ ongoing probation violation hearing Jason Jensen had his motion for reconsideration of the Judge’s ruling against recording in the courtroom based on the allegation that the hearing was a “secret court” that was off limits to the public denied when the Judge reminded Jenson that he was present in the courtroom in the public gallery during the most recent hearing in the case.
Judge D. Douglas Metcalf wrote:
Non-party Jason Adam Jensen has filed a motion asking the court to reconsider its Order that denied his previous request to use a personal audio recorder to record the pending probation revocation proceedings in this case.
Contrary to Mr. Jenson’s argument, the courtroom has remained open to the public for these proceedings. The court’s Order denying Mr. Jensen’s request to record the proceedings does not limit his access to the courtroom. Indeed, Mr. Jenson was present in the visitor’s gallery during the proceedings.
Based on the foregoing,
IT IS ORDERED that non-party Jason Adam Jensen’s motion for reconsideration as to the use of a personal audio recorder is DENIED.
Arizona’s Court of Appeals Division Two had previously declined to hear Jenson’s special motion to appeal Judge Metcalf’s ruling last week. That court is set to receive Jensen’s paperwork to appeal to the Arizona State Supreme Court by September 21, 2026.
While Jensen is not a supporter of Lane Myers, he is a resident of the area who has previously filed an amicus brief with the court that was rejected after both sides in the case objected to his participation.
Jensen’s objections to Metcalf’s ruling against audio or video recording of the proceedings comes as Myers himself commented on the state of recording in a recently released jailhouse interview with Zachary “Liberty Troll” Kueker.
There is, there is, but they won’t release it. It’s absolutely being recorded on audio They just won’t release it. Now somebody needs to file a a lawsuit to get them to r because by law they have to release the audio. And I can tell people what they could because uh somebody in Arizona would need to file the lawsuit to get the audio.
Because if we really want to get into ditty gritty, there’s there’s court rules that say it has to be audio recorded and it has to be made available to the public. The public No, we don’t the public doesn’t need an official transcript just to know what happened. And that’s where Metcalf that’s why people need to start calling Metcalf and and we need a new judge anyway.
Audio recordings of hearings in the on-going probation violation proceedings have been an issue with Myers’ camp in the past. Friend Joshua “This is a Public Service” Grey had previously posted on his YouTube community page in protest of the inability to purchase a recording of a previous hearing due to the presence of a court reporter in the courtroom.
In Pima County, Arizona, the standing rule of the courthouse is that if a court reporter is present, any audio recording by the court is unable to be released to the public.
Grey’s protest of having to pay for a transcript when Judge Metcalf had wrongly stated that an audio would be made available for purchase of a previous hearing resulted in Metcalf providing a transcript to Myers of that hearing at the expense of Pima County taxpayers.
After that snafu, Metcalf announced that a court reporter would be at every hearing and no audio or video recording would be permitted during future hearings.
That ruling has led to accusations by Myers’ camp that Metcalf is running a “secret” court with the public blocked from following the case. As Metcalf correctly pointed out in his Monday ruling, the public has the ability to attend hearings in person and transcripts are available through direct contact with the court reporter.
New attention to Myers’ case based on the ruling did not result in new donations to Myers’ GiveSendGo campaign. John “First Amendment Protection Agency” Medaglia’s ILLEGAL ARREST DEFENSE FUND!!! Campaign took the crowd sourcing title for Tuesday with $5.00 in new donations.
