First amendment auditor Jeremiah “Last Days of Freedom” Payne released an extended statement in a video on his YouTube channel on Thursday updating his version of events leading up to his arrest on burglary charges last month while addressing negative news coverage he’s received following the arrest.
Payne was apparently arrested last month after an incident where he claimed he was looking in the windows of a house that he was interested in renting. According to Payne’s original statement made in a comment on our reporting, he never entered the house and that he did not take items that were later reported missing from an open garage.
His latest statement clarified the identity of the good Samaritan who posted his bond. In that statement he claimed that part of the money was put up by a “private donor” and the rest was put up by a friendly bail bondsman.
Payne went on to chastise those reporting on him and implored his viewers to withhold judgement until after court proceedings proved his innocence.
The YouTuber was picked up on the charges in early September and spent multiple weeks in jail as his bond was set at $25,000.00. No effort was made by his wife Samantha to create a new GoFundMe account to help raise bond or to go live on his YouTube channel to raise funds for his release.
It is unclear how well a crowd sourcing campaign would have been as a previous GoFundMe campaign from the summer devoted to raise money for funeral costs of his mother failed to earn any donations.
Payne stated:
Look guys, I’m gonna say one thing I Yes I was charged with something that I did not do. Okay I can’t say too much about it because the case is still ongoing. I gotta go back to court in January. But um
Needless to say A bondsman that I have known for at least 25 years. He put up his own money and got me out. Well Uh there was about 1300 put up from a private donor and he put up the rest of it because they gotta have at least 5% of it to be able to get you out.
Anyways, I’m out And just because you’re charged with a crime, guys, it doesn’t automatically make you guilty. That’s why I’m going through the court system and I’m gonna fight it. Like my attorney said Um, they read me no Miranda rights before questioning me. They coerced me into believing everything was on video of me walking around the house looking in, which is not a fucking illegal.
And When I was there, the uh garage that’s not connected to the house that sets behind it, the front door on it was already open like this much. And all I did was kind of look in it to see what was in there and it looked like a bunch of junk, crap, dust, spiders.
I didn’t even attempt to go in it. I wouldn’t go in it. But we were Samantha was on the phone calling the guy ’cause the house is for rent Didn’t get no answer, she left a voicemail, and that ‘s all that happened. And then I guess somebody who had went into that garage and took shit or did something, they assumed it was me because they got me on camera walking in front of the house looking in the windows.
Which burglary guys is when you enter a house I didn’t enter no house. I didn’t enter anything. I walked around it. I looked at the outside. I looked through the windows that you could see through that they had wide open. Did trying to figure out how big the living room was, how many bedrooms it was. That’s all I was doing.
And I’m going to fight this all the way. It’s going in before the grand jury now. So I will have What is it, nine or twelve people that would decide if I did anything or not? I mean, come on guys. Y’all are like jumping on the ball running, he did it, he’s guilty, he’s a thief, blah blah fucky blah. Y’all don’t fucking know anything about this That’s all I can say about it right now because like I said the case is still ongoing But you motherfuckers need to shut your mouths until The facts come out in a court.
And then let’s see you run your mouth. Because the facts are going to prove Jeremiah didn’t do shit. Jeremiah didn’t enter nothing. There’s he said the only video of me is when I walked around front and the ring camera caught me. That’s it There’s no video of anything else happening.
No video of me entering anything. The dude couldn’t even testify that there was anything missing. I mean it should have been thrown out right then instead of Perry, Judge Perry, pounded it over to the grand jury just because he hated my dad.

But in this special case Pain said they only needed 5% so that would be 1250$
Okay so when he said this:

Again. He is confused. Police can ask you all sorts of questions. They do not have to read you your rights and they never have to tell you the first thing a lawyer will tell you, which is to shut up when questioned by a cop.
What happened was the cops started to ask him questions so he could freely walk away at any time but instead he elected to remain and incriminate himself before they took him into custody. Where, once he was arrested they would have to read him his Miranda rights if they started to ask him further questions. So long as you are not under arrest, they do not have to say anything about your rights.
If a cop, any cop, asks you questions, answer, “AM I FREE TO GO” that is it. If they say yes, then walk away as fast as you can. PERIOD. Do not talk sports, the weather, go home, get lost, get as far away from the cop as you can as fast as you can.
When police stop you for questioning, they are not your friend, not your bro, not your buddy, they are seeking incrimination. Just ask, “Am I free to go.” and if you get a yes, leave. If you get a “no” you are under enforced custody and they must read your Miranda or anything you do say is not admissible. Its all on camera, cops body camera, so your lawyer will be able to use it.
If asked anything by police, reply, Am I free to go. Or My lawyer advises me not speak with police when questions unless he is there. Or I invoke my right to remain silent. Or With respect, i would like to speak with my lawyer before answering questions.
Every idiot thinks that they can talk with a cop and walk away cause they are smarter than the cop. Guess what. You are not. So SHUT UP.
I can say this a million times, every lawyer you will ever meet will tell you to shut up when questioned by police and for what? People simple do not listen. So, when Pain, goes to jail for telling the cops everything he has done, they will use everything he said against him.
Anything you say can and will be used against you…
So, like his videos, where Pain, ever the helpful idiot, admitted to the elements needed for an arrest to the police and then repeated them afterwards twice on YT, cause police are clearly never smart enough to find anyone channel on YT, ask Lame Meyers how that worked out for him in cases…
Go about your life. If stopped , asked if you are free to leave. If the answer is yes, then leave. If it is a no, then ask for a lawyer to be present while you are being questioned. If the cops say anything, you simple take what they say and use it back to them. Cop says. it would help us greatly is you made a statement. Sure Officer, I would love to, as soon as my lawyer gets here.
Remember this, a cop is not doing anything for fun. He is looking to put you in jail. Act like it.
