The quiet of the weekend was interrupted on Sunday as everyone’s favorite Tennessee based first amendment auditor, Jeremiah “Last Days of Freedom” Payne released to his YouTube community page a cease-and-desist notice targeting the Judge and Executioner channel along with an AI generated music video attacking that channel along with fellow critic of Payne, KFARR.
The two channels targeted by Payne have had a long history of criticism of the activist and his lifestyle. The Judge and Executioner channel released not one, but two AI generated music videos aimed at Payne in apparent response to his cease-and-desist notice.
KFARR appears to be unaware of Payne’s attack music video and has yet to post a reply to it.
The video itself highlights Payne’s recent turn to music producing. While the YouTuber has claimed that none of his music uses AI, critics have pointed out that Payne’s frequency of music dropping, putting out multiple albums in a year, with no visible appearances with human talent make those claims questionable.
It’s unclear what legal power Payne’s cease-and-desist holds as Payne is not an attorney and has a long history of threatening lawsuits but failing to follow through with them. In fact, Payne’s threats to sue placed the long-time YouTuber in the semi-finals of the ReallyCoolNews “What Will Happen First?” tournament for August.

Re: Unauthorized and allegedly defamatory content concerning Jeremiah Payne, his music, and members of his family
This letter serves as a formal demand that you immediately cease and desist from publishing, republishing, distributing, or otherwise communicating content concerning me, Jeremiah Payne, my music, my wife, or my daughter where such content is false, misleading, defamatory, invasive of privacy, or otherwise unlawful.
I specifically demand that you:
Immediately remove any posts, videos, recordings, images, statements, songs, comments, or other content that contains false or defamatory statements about me, my music, my wife, or my daughter.
Cease further publication or republication of such material on any website, social-media platform, video platform, music platform, or other public or private forum under your control.
Do not use my wife or daughter as subjects, references, or material in connection with content concerning me or my music, particularly where their personal information or identity is being used to attack, harass, threaten, ridicule, or falsely portray me.
Preserve all potentially relevant evidence, including original files, recordings, messages, posts, comments, account information, publication dates, editing histories, and communications relating to the creation or distribution of the disputed content. This preservation request is made so that relevant evidence is not destroyed or altered.
Provide written confirmation that the requested material has been removed and that you will refrain from publishing substantially similar unlawful content in the future.
This notice is intended to provide you with an opportunity to correct the situation before I pursue available legal remedies. If you continue publishing or distributing statements that are false, defamatory, or otherwise actionable after receiving this notice, I will consider pursuing appropriate legal action, which may include claims for defamation, invasion of privacy, harassment, or other applicable causes of action, as supported by the facts and applicable law.
Nothing in this letter constitutes a waiver of any rights, claims, remedies, or causes of action available to me or my family. All such rights are expressly reserved.
You are hereby placed on notice to preserve all evidence relating to the disputed content.
Please direct any response regarding this notice to me in writing.

This is not how you go about doing something like this.
Though the AI did almost a good copy paste job on the notice. It still means nothing.
But wait, it gets worse!
See, the thing to do is get a lawyer. Not a chat bot, a real lawyer.
That would cost money. How much? So this maybe 2 grand? Maybe more. To write it up all nice and legal and serve it legally. Cost vary by state and even by city. So don’t take my word for it. Go ask Merb how much he would charge. You can ask Darcy, but i suspect he would charge a lot more than Merb.
But i digress… No matter how much it cost, it would cost too much for this guy to afford.
But wait, it could get even worse.

Said person wrote a song making fun of someone. And? Parody is protected free speech. Hence when Hustler called Jerry Falwell their first bad word @$$ or see you next Tuesday, something like that and he sued. He properly served them and he even had real lawyers. And it went all the way to SCOTUS and he lost. Parody and insult making humiliating comments in print are legal expression of opinion. As such, they are covered under the 1A .
Note that a 1A auditor would know ANYTHING about the 1 ST.
