Jose “Chille” DeCastro Labor Day weekend recovery saw the YouTuber get two minor victories in his lawsuit against Dale “Lackluster” Hiller, Josh “Accountability for All” Abrams and Kate Peter, a new filing for e-mail service in his lawsuit against John “Irish Demon” O’Dea, and troubling signs with his viewership for his annual Labor Day livestream celebration of himself.
Starting with the O’Dea case, DeCastro’s lawyer, That Randall S. “The Unhinged Attorney” Newman, Esq, filed on Wednesday an request for e-mail service to O’Dea and apparent business partner Joe Famalette of the Creator Growth Group investment fund.
The Filing shows that O’Dea acknowledged legal action by DeCastro as Newman explained, “On July 31, 2025, Defendant appeared in and posted a video to the Irish Demon Channel titled ‘Happy” Birthday to Me….’ In that video, Defendant stated ‘Oh yeah, I’m getting sued by Jose DeCastro for a video that I put up two years ago.’”
At the time, DeCastro had only filed a subpoena for O’Dea’s records from YouTube but did not file his actual lawsuit against O’Dea until August 5, 2025. O’Dea has not replied to an Acknowledgement of Service form sent to him via e-mail when that case was filed.
Newman’s filing also stated that the Australian mailing address provided by O’Dea in his DMCA Counter Claim to a November 18, 2022, DMCA takedown notice was either false or no longer reflects O’Dea’s current address.
At the time of the counterclaim, O’Dea was living in Ireland and has continued to maintain his primary residence in the country since that time. Newman asked the court to allow e-mail service of the lawsuit as O’Dea swore in the DMCA Counter under the threat of perjury that his mailing address was in Australia, which proved to be false, while also indicating that he would also accept service via his primary e-mail.
Newman also asks for O’Dea’s apparent business partner, Joe Famalette, to be served via e-mail as an alternative to serving O’Dea. According to Newman, he was contacted by an attorney representing Famalette and the Creator Growth Group investment fund, which confirmed that the fund has a stake in O’Dea’s main Irish Demon channel.
Famalette is apparently listed as an investor and co-operator of the Irish Demon channel. While Famalette may not have been involved in the DeCastro’s channel that O’Dea publicly confessed to, his ownership status does make him a party to the DMCA based charges.
DeCastro’s luck also improved over the week as he was granted the ability to use the Electronic Filing system to make filings in his Massachusetts based federal lawsuit against Dale “Lackluster” Hiller, Josh “Accountability for All” Abrams and Kate Peter.
He also was granted his request to extend service to the trio as he was claiming that they were professional YouTubers who had the ability to hide their identities and address from service.
District Judge Leo T. Sorokin: ELECTRONIC ORDER entered: re 11 MOTION for Extension of Time to November 1, 2025 to Effectuate Service. Plaintiff’s Motion for Extension of Time (Doc. No. 11) is ALLOWED. The time for service is extended by the requested sixty (60) days. The deadline to serve the Summons and Amended Complaint is November 3, 2025. (SED) (Entered: 09/03/2025)
DeCastro is not represented by attorney Newman in that lawsuit.
The week was not all sunshine and rainbows for the YouTuber, as DeCastro’s traditional Labor Day livestream celebration of himself went about as well as anyone could imagine. The extravaganza of Chille saw a huge number of shorts views, next to no likes for that number, a smattering of comments scattered here and there in response to his three-hour and ten-minute celebration of himself.
With 169,451 short form views leaving 1,106 likes for the stream, DeCastro actually did a below average number of .65% like to view ratio. His 49 comments to 169,451 views did even worse, converting .0289% of his viewers into commentators.
He managed to take in $87.00 in new super chat donations during the live event, down from more recent streams, and he peaked at 1,367 concurrent viewers in the first 21 minutes of the stream.
DeCastro could probably blame the holiday for his declines, as his August 31 livestream brought in 332,000 views, brought in $630.00 in super chat donations, but even that 5-hour broadcast still only did 1,400 likes and brought in 33 new comments.
It seems like DeCastro is benefitting from going live in the vertical format after a week’s suspension, as he brought in 2,000 new viewers between August 31 and September 1, to bring his total subscriber count to 673,000.
DeCastro’s interactions with his fans should be worrying, though, with his fan base failing to bring him over 2,000 likes even when he is exposed to over 332,000 viewers. It’s not for lack of trying, as DeCastro is constantly telling his viewers to hit the like button or tap the screen to “like” the videos.
However, observers note that the fact that DeCastro seems to be fine by stopping at 1,000 likes when he’s being exposed to a wider audience is reflective of his lack of effort to keep new fans around.
Likewise, DeCastro does not take the opportunity to remind his fans of his on-going GoFundMe campaigns and often forgets to plug his Venmo, CashApp and PayPal donations links during shows – especially the bigger shows.
It’s reflective in his financial gains from the more recent livestream, where he mentioned nothing and gained next to nothing. His GoFundMe campaigns both brought in no money for Tuesday and Wednesday because of this, with no gains for either day.
DeCastro rival SeanPaul “Long Island Audit” Reyes won Tuesday with $64.00 in new donations to his Help me Fight These Unlawful Charges & Injustice fund, followed closely with $25.00 donations to his Support the Fight Against Tyranny & Corruption fund.
Wednesday saw our own On-Going Expenses campaign take the day with a $200.00 donation. Reyes’ Help me Fight These Unlawful Charges & Injustice campaign earned $35.00 in new donations to take second place for the day.
No other observed campaigns saw new donations for either day.

O’Dea is in Ireland. Email service is not allowed in Ireland. Nor has Ireland signed the Hague convention. So, any such service is… poo. Every web site I have read, says clearly, when servicing someone in Ireland, contact a local attorney to make sure you are following Irish law. How much do you want to bet that mere emailing to Ireland won’t cut any irish mustard? Not that any of this is legal advice, if you came here for your legal advice, you have a few too many pints of Guinness.
As for his business partner? Joe Famalette and the Creator Growth Group investment fund, hmmm ya. They list a number of YT channels, most are dead for months onto years. So how is it they make money again? Oh wait, its another scam that Irish just loves to play. Oh and how much $$$ do you want to bet that they just happen to have an addy is… Ireland? See above for more details. In other words, the players are being played by O’dea cause their case is BS, they are BS and this whole court thing is even more BS. But hey, you did not hear any of that from me…
cause I just wrote it, idiot!
Next, O’dea’s address. Where oh where do you live? Oh wait, its not where you live now, its where you lived 2 years ago. Hmm. So there is now a law that says you must provide an address to be sued forever. Maybe only on YT. In the real world there is no requirement for an address to be viable for longer than needed. To wit, if I work in an office, 9-5. Those are the normal hours of service. So, I give my office address. They show up with the lolsuit, the receptionist signs for it and service is done. Well, a year later I change jobs, moved on or got fired, does not matter. And then 18 months later the receptionist who knew me, is also promoted or fired but is no longer in the receptionist seat. So… Service arrives after 2 long years and low and behold the address is not valid. So, shocked. To then call the address a fraud, is a legal conclusion made by a judge. But in this case, it is intended to poison the well and say bad things about the defendant. This is why most good lawyers, and even some bad lawyers tend to be very carefully, giving full consideration in what they say in order to avoid having to prove something in court. Or as your grandmother would say, keep your word light and sweet. You never know when you will have to eat them.
Always remember you may be called upon to prove any and all assertions! The so called fraud in the address provided being one of the claims they may need to prove and not merely assert as he does in all other things.
Next up service to Kate. Well, chilli needs more time to send them the suit? or is it he needs more time to get the money to pay for service? Or is it chilli is just too messed up to focus on what to do?
And did they all move from the last time he sued them? Is kate still represented by Ben Wish? Will chill serve Wish this time or will he simply not figure it out?
It has become a joke to see how many filing deadlines he has missed, forgotten, or simply ignored. In EVERY lol suit, he misses deadlines. He even filed this lolsuit passed the statute or limitations. So there is nothing news in this.
One last joke, we know chilli bought his subscribers… now he is buying his viewers… Oh boy, you just got to love his consistency!

If I were you, I too would want to be me. Sadly, you must exist as yourself and can never hope to be me.
