DeCastro Fires Attorney, Demands End to Blue Bacon Case (Corrected)

In a surprise pair of filings, Jose “Chille” DeCastro fired his attorney in his California Superior Court lawsuit against Michael “Blue Bacon” Pierattini, Daniel Clement, Team Skeptic and Kate Peter, before asking for the suit against Pierattini, Clement and Skeptic be dismissed.

The moves were made by DeCastro at mid-week last week but only posted to the California Superior Court’s website late in the day on Monday.

The release of the filings come literally two days before DeCastro was scheduled to attend another hearing in the case, which was likely to see the case dismissed as Pierattini’s attorney had argued the final issue facing his client should be dismissed.

DeCastro previously filed suit in 2023 with a then February 2025 date set for a jury trial, alleging a vast criminal conspiracy involving the so-called “Masshole Troll Mafia.” His lawsuit was essentially a retread of a Federal Civil Rights lawsuit he filed against Kate Peter and others in Massachusetts in 2022, which later evolved into a copyright case against Peter, Google/YouTube and others that was later dismissed.

Pierattini’s attorney, R. Paul Katrinak, had previously had the majority of the claims against his client dismissed via summary judgment. The final claim, which involved DeCastro’s conflicting statements to his status as a “private” or “public” citizen, had yet to be heard.

A hearing was set for Wednesday to discuss the outstanding sanctions that DeCastro had yet to pay, and a call for new sanctions, including terminating sanctions for DeCastro’s multiple late filings, ignoring direct orders by the court and refusal to pay the previous sanctions.

The hearing was also scheduled to set a trial date for the long-running lawsuit.

As DeCastro has fire his attorney and asked for the claims against Pierattini, Skeptic and Clement to be dismissed without prejudice, the YouTuber is apparently attempting to avoid Judge H. Jay Ford III ending the case in favor of Pierattini, and, instead, ending the case at his request, only to pick it up again at a later time.

DeCastro is not asking for the charges against Peter to be dismissed. In 2023, the Court Clerk found that Kate Peter was in default for not properly responding to service in the case. Judge Ford has not declared a default judgment in favor of DeCastro, and DeCastro would still need to prove damages from Peter in order to receive said judgment.

In more DeCastro news, he again failed in his promise to Craig Hendry on Monday as he did no release the long-promised GoFundMe for Hendry. DeCastro had set a “by Monday” deadline as part of his Saturday livestream, assuring fans that he would finally get around to setting up the GoFundMe to raise money for Hendry’s $12,000.00 bond for charges out of Sullivan County, Indiana.

DeCastro’s lack of action did nothing to spur the market as the crowd sourcing campaigns we follow put up goose eggs for a second day.

    LOL chilli thinks he is getting a HUGE i say again HUGE pay day from Kate, who he never served properly to begin with. But if he had, he would still not be getting a pay day. He has show no damages in his filings. He has shown no connection within his filling to Kate and what he has filled for BB is always we will show you later. Well the “later” is question having long passed. The judge is not going to award him the time of day. He will dismiss the case with prejudice as chilli is in default on so many levels. He will award BB more money that BB may never collect… well he might be able to get some from YT is chilli is even making any money there. Otherwise this case is still as dead as it was when it was first filled two years ago?

      Just noting that Chille has abandoned his GoFunMes an anything public lately. He’s taking private donations directly on his website with no way to measure his income.
