Thursday saw a day of mixed blessings for Jose “Chille” DeCastro as he won a motion in his on-going federal lawsuit against the city of Duncan, Oklahoma, and ultimately gave up on his dream of hiring superstar attorney Josh Tomsheck of the firm Holland & Tomsheck as the failed Power Ranger suspended his most recent GoFundMe campaign.
Starting with the rare win, after months of limbo, United States District Judge Charles B. Goodwin wrote:
“Now before the Court is Plaintiff Jose Maria DeCastro’s Motion (Doc. No. 29) seeking leave to file a surreply in opposition to the pending Motion to Dismiss (Doc. No. 24). No response to Plaintiff’s Motion has been filed within the time allowed by local rule.
Plaintiff’s unopposed Motion (Doc. No. 29) therefore is GRANTED. Plaintiff shall file the surreply (currently presented as an exhibit to the Motion) within fourteen (14) days of the date of this Order.
IT IS SO ORDERED this 6th day of August, 2026.”
This is the lawsuit that arose from charges pressed against DeCastro last year in Duncan, Oklahoma, for molesting a police vehicle. DeCastro has a warrant for his arrest and is suing on First and Fourth Amendment grounds in federal court to block his arrest warrant and to stay his prosecution of the state level charges.
DeCastro had filed in June a motion requesting to file a sur-reply to defendant Suzannahe Smith’s motion to dismiss the charges DeCastro has made against her. Smith had filed her motion to dismiss in April, with DeCastro filing his opposition response in May and Smith countering his response also in May.
The inventor of the jock sock had claimed that Smith raised new arguments in her reply to DeCastro and wanted one more shot to refute those arguments. Smith did not oppose his filing and Judge Goodwin’s ruling was not a surprise.
As DeCastro found rare success in court, he failed with yet another GoFundMe. This time he made the decision to shut down his crowd sourcing campaign to hire Tomsheck to handle his primary attorney for a single charge of walking in the road when a sidewalk was available from a July arrest.
Attorney Michael Mee will apparently represent DeCastro in the remainder of that case. DeCastro has yet to announce if refunds will be made available to those who contributed to the hiring of Tomsheck
DeCastro’s Help Me Defend My Constitutional Rights campaign was silent on Thursday as Lane Myers’ GiveSendGo took the day with $130.00 in new donations. He was followed by SeanPaul “Long Island Audits” Reyes with $26.00 donated to his We the People vs. Police Union Power campaign.
Christopher “Direct D” Ruff’s Help Chris “Direct D” Ruff Get Home GiveSendGo campaign placed third with $5.00 in new donations. It is noted that Ruff’s partner, Amanda, announced that they would be shutting down that campaign as well on Thursday and refunding all donations. They’ve asked those who donated to take the refunded money and make donations to Ruff through other means.
The entire market saw goose eggs for Friday’s take, with no observed donations across the board.
DeCastro’s decision to shut down his GoFundme campaign marks the second straight failure of a DeCastro crowd souring campaign. In July, he prematurely shut down his Help Me Finilsh YouveGotBail and Protect the Technology campaign just days after proclaiming himself a professional fundraiser and declaring that he had never failed in his fundraising efforts.
As we’ve noted, the loss also throws doubts on DeCastro’s crowd sourcing abilities, and he seems to have at least temporarily abandoned plans to launch his nationwide YouVeGotBail.AI social media/crowdsourcing platform due to lack of funding.
All was not horrible for DeCastro on Thursday as his “No Copper Suh King round Here – We Do Not Back the Blue” livestream pulled in $746.00 in super chats over its seven-hour run time.
DeCastro is expected to livestream later this morning.
