Monday saw James “James Freeman” Springer (Freeman) respond to a recent show cause order by the Judge in his lawsuit against new Mexico’s Seventh District Court by ignoring the order and instead, ask leave for permission to sue various defendants in their official capacities.
The Previous order essentially asked Freeman to show why he should be allowed to continue his lawsuit without showing what each defendant had done to deserve being punished for their actions. He was also asked to explain why the inherent judicial immunities should be ignored as he was trying to sue judges who have protections in place from being sued due to their job.
Freeman’s reply completely ignores the order to show cause, the very purpose of the order and what the judge wanted to see from him, to instead make a case that he should be allowed to sue the defendants in their individual capacities. While it does address one of the issues that the judge asked about, as a hole, it fails as it doesn’t do what the Judge wanted and explain why the defendants are at fault.
It appears that the reply itself is just another delay tactic by Freeman’s team. He is under order to show cause by the end of the month. He has another 14 days left in the month to submit an actual reply to the order.
By splitting the show cause and suing in individual capacity order into two parts, he now gets another two weeks for the defense to reply to one half of the order, then release his replies to the show cause order separately to gain yet another two weeks for the defense to reply to the new order, then he can reply to the first order and so on and so on.
There is no end game for this case on the part of Freeman’s team. The delay tactics are simply a repeated element of the lawsuit and may not survive if Freeman fails to actually reply to the Judge’s direct demand for him to show cause or face a dismissal of the case.
