James “James Freeman” Springer’s (Freeman) appeal of the recent decision of Judge Margaret I. Strickland to terminate multiple defendants from the lawsuit while ordering Freeman to file a new amended complaint against Judge Mercedes Murphey has moved forward.
Freeman filed a $605.00 filing fee to the court of appeals on May 31, 2024, and on June 3, Magistrate Judge Jennifer M. Rozzini vacated the settlement conference set for June 18 and all deadlines set in previous orders related to settlement talks.
Freeman’s documents and preliminary records documents were transferred to the appeals court and a USCA case number was assigned on June 4, 2024.
The appeals court has not officially indicated that it will hear the appeal as of press time. Therefore, the initial briefing from Freeman’s team has not been filed as of yet to detail the extent of Freeman’s claims, or to detail what exactly Freeman is appealing at this time.
Freeman’s original lawsuit involved his claims of first amendment violations in regard to restraints placed on his access to Court buildings in New Mexico’s seventh district courts.
After multiple incidents involving Freeman in 2023, an order was issued that Freeman could not enter Court buildings within the district unless he had official business and was accompanied by a police escort.
Freeman’s lawsuit was almost entirely dismissed last week as he failed to properly respond to an order by the court to state claims against the defendants that could provide actual relief.
Judge Strickland released defendants Jason Jones, Shannon Murdock-Poff and Susan Rossignol from the lawsuit, and offered Freeman a limited path to continue the lawsuit against Murphy with a new amended complaint.
