Jose “Chille” DeCastro is set to appear in California court today as part of the latest hearing in his lawsuit against Kate Peter, Team Skeptic, Daniel Clement and Michael “Blue Bacon” Pierattini.
The YouTuber is expected to miss his fourth or fifth hearing in a row today as he is incarcerated in the Clark County, Nevada, Detention Center and apparently has not attempted to attend the hearings, resulting in a string of losses in rulings in the lawsuit.
Today’s hearing, according to the declaration of Pierattini’s attorney R. Paul Katrinak, will see a substitute attorney fill Katrinak’s role as he is involved in a federal trial at the scheduled time and date of the hearing.
The declaration indicates that Katrinak has not received any discovery from DeCastro since DeCastro was ordered to provide discovery. He also has not received any communication from DeCastro nor payment of the previous monetary sanctions owed to Pierattini and Katrinak from previous rulings.
Katrinak claims that he has no idea where DeCastro is or why he is ignoring the case. While it is widely known that DeCastro has been incarcerated in the Clark County Detention Center for over two months, DeCastro himself has not updated the court as to his whereabouts as required to do so.
Because of this, Katrinak is asking for a new round of sanctions against DeCastro in the form of a $4,560.00 as DeCastro has also not attempted to schedule the deposition he was ordered to sit for in previous rulings. Katrinak is also asking Judge H. Jay Ford III to order DeCastro to sit for the deposition within the next 30 days.
Katrinak also asked for the Court to set an order to show cause since DeCastro has been ignoring the case and has run up the attorney’s fees for Pierattini because of it.
DeCastro filed the lawsuit in early 2023 as his previous lawsuit in federal court against Kate Peter and others had morphed from a harassment and defamation-based suit into a copyright lawsuit against Peter and her co-defendants and YouTube/Google.
After revising that lawsuit, he filed the current lawsuit in California’s Superior court to go after Peter and individuals who he claimed to be part of the “Masshole Troll Mafia” including Pierattini, Skeptic, Clement and a number of John Doe defendants.
In the year and a half that the lawsuit has been active, DeCastro has failed to state what actions he is holding Pierattini responsible for (as Pierattini is the only active defendant in the case) and has apparently been unwilling to cooperate with any action that would result in moving the lawsuit forward.
A ruling by Judge H. Jay Ford III is expected in the case later today.
DeCastro may have gotten some good news on Tuesday as a new listing for DeCastro’s upcoming trial in the city of Las Vegas for obstructing an officer seems to have been moved to August.
The YouTuber was originally due to be in court next week for a pre-trial hearing in the case, the new listing seems to indicate that hearing has been continued until August 13 at 1:30PM local time.
