As expected, YouTuber John “Irish Demon” O’Dea did not reply to the lawsuit served on him on behalf of Jose “Chille” DeCastro earlier this month in a lawsuit filed by That Randall S. “The Unhinged Attorney” Newman, Esq.
O’Dea is accused of a variety of offenses surrounding a November 2024 hack of DeCastro’s main YouTube channel that resulted in the suspension of the channel. He is also facing charges of misrepresentation and declaration of copyright infringement for using DeCastro’s copyrighted works.
DeCastro is claiming significant damage to his channel and branding, as O’Dea allegedly played hardcore pornography on DeCastro’s channel in several coordinated attack sessions.
According to DeCastro’s initial complaint, overall damages are expected to exceed $75,000.00 for loss of income, goodwill, and business opportunities.
DeCastro had previously claimed that the loss of YouTube revenue caused him to lay off up to six employees and that he has yet to recover from the financial losses from being off-line during the suspension.
While he was eventually paid the revenue he earned for November, he lost revenue for not being able to livestream during the suspension, leading up to the busy Thanksgiving holiday.
Despite claims from fans of O’Dea, O’Dea agreed to be sued in the Northern District of California when he filled out his counter-DMCA notices to fight DeCastro’s DMCA takedown attempts.
O’Dea himself acknowledged the lawsuit over the summer on a livestream where he said he heard that he was being sued by DeCastro while lying in a hospital bed after a motorcycle accident.
Since that time, however, he has avoided the subject. While an attorney for a supposed partner of O’Dea came forward to represent the partner on O’Dea’s Irish Demon channel, O’Dea himself has remained silent on the lawsuit. O’Dea’s partner is not officially part of the litigation.
Attorney Newman was given permission to serve O’Dea via e-mail early in September, with O’Dea having three weeks to respond to the deadline. As O’Dea missed the deadline, Attorney Newman gave O’Dea an extension to file his reply by September 29, 2025.
That deadline passed without a reply, resulting in the filing of the default by the attorney.
The court clerk is expected to file the default later on Tuesday. While the clerk can find O’Dea in default, it is not the end of the process. From here, there are several steps to take the default and have the Judge rule for DeCastro in a default judgment.
Newman may ask for discovery before making a motion for default judgment to the Magistrate judge assigned to the case. After that, DeCastro will still have to prove damages from O’Dea’s alleged actions.

Attorney Newman provided his thoughts on the default to ReallyCoolNews after the initial version of the story was recorded and after newsreader Pants was unavailable for the rest of the day. We include it here in it’s entirety:
“Today we requested the Clerk of Court enter a certificate of default against Mr. O’Dea. This is the first formal acknowledgment by the Court that he has been served, that the deadline to respond has passed, and that he has chosen not to defend himself. A certificate of default is more than paperwork — it means the defendant has forfeited his right to contest these allegations on the merits.
Mr. O’Dea’s conduct on November 22, 2024 was not some harmless internet prank. It was a calculated cyberattack designed to humiliate Mr. DeCastro, poison his reputation, and cripple the very platform that supports his work. When you hijack someone else’s channel to broadcast pornography and impersonate their voice, you cross the line from mockery into unlawful sabotage.
This default is the first step toward accountability. The next step will be moving for a default judgment, where we will ask the Court to award damages and issue injunctive relief. Whether Mr. O’Dea ever sets foot in an American courtroom or not, he cannot evade the consequences of what he did. The record will speak for itself, and the Court’s judgment will carry the weight of the law.”

The default means nothing.
Let them go through the process and incur costs and expenses and then at the very end. Drop the bomb on them and have the judgement tossed.
They have all this evidence…
Yes and what evidence it is. Irish made it for them. And will stand up in court and swear he did so. He will have his co-conspirators stand up and say they were in on it from the start.
They can show damages,
Not without perjury, Not that chilli would not lie through his teeth but the judge is used to such things. While born in the morning, it was not yesterday morning.
And when all is said and done. Even if they win something in Cali, it has no meaning in Ireland.
You want to sue Irish Demon, you get on a plane, you go to Ireland and get an Irish lawyer to serve him an Irish lawsuit, You show real evidence not what Irish made for you. You show real damages, not whatever chilli delusions think it should be, Seriously, take chilli’s face and put it on top of Dr Evil and demand One million dollars…
