Dr. Dave Shares Secrets on DMA Sunday Livestream

YouTuber Dr. Dave appeared courteous and polite on Sunday’s live stream where he shared the air with Chistopher “Denver Metro Audits” Cordova, Zachary “Liberty Troll” Kueker and that Randall S. “The Unhinged Attorney” Newman, Esq., on Cordova’s channel, apparently forgetting that he’s being sued by two of the three men and giving out information that may have doomed others who will be targeted by the trio.

The livestream was scheduled as a simple update of Cordova’s on-going lawsuits and was winding down after a series of short updates when Dr. Dave joined the panel.

Cordova had spent much of the time complaining about how members of the public saw Jonathan “Frauditor Troll” Hudon-Huneault’s wife as “hot” while not applying the same term to his ex-girlfriend, Theresa “Sweet T” Neal.

Cordova and Newman also shared criticism of Hudon-Huneault’s e-begging to fund his defense against the lawsuit Cordova brought against him, after Hudon-Huneault has spent years criticizing auditors for fundraising off their needs to defend themselves in court.

Attorney Newman took issue with California based attorney Patrick J. D’Arcy, after it was revealed that D’Arcy did not disclose that he had been paid by Hudon-Huneault when he attempted to file a “friend of the court” brief last month to interject himself into the Cordova vs. Hudon-Huneault lawsuit.

Newman also mocked the fair use idea as a defense. Indicating that if Hudon-Huneault were somehow to prevail in his lawsuit with a “fair use” defense, the pair could simply open a new channel, play popular TV shows or movies in 6-minute chunks and add an emoji or short commentary to break up the segments and qualify for the same protections.

Shortly after a mention of Dr. Dave’s partner Gail Buma, who is being sued by Kueker for taking responsibility for Dr. Dave’s channel in DMCA counterclaims, the pair would be joined by Dr. Dave and, later, Kueker.

After pleasantries, Dr. Dave stated that he had no real problems with First Amendment auditors, other than those who camp outside of banks, dispensaries and restaurants for content. He made the point that interfering with day-to-day activities to create conflict for content really wasn’t the purpose of auditing.

Dr. Dave mentioned that he had been making changes to his life, as he was nearly 71 years old, had stopped drinking beer two years ago, and was retired with YouTube as a “hobby” and not a job. While he admitted he wouldn’t be making videos if he wasn’t profiting from them, he again characterized his activities as a hobby.

When asked about the lawsuit that Newman is handling for Liberty Troll, Dr. Dave facetiously disavowed any knowledge of Gail Buma, who he had previously described as his “partner” on his own livestream.

He also denied having any contact with attorney D’Arcy, despite D’Arcy’s statements in his proposed “friend of the court” brief that he had been directly contacted by Dr. Dave among other defendants in the lawsuits that Newman had filed. Dr. Dave would continue to deny any connection with D’Arcy throughout the livestream.

Kueker then joined the panel and Dr. Dave claimed that his recent targeting of Kueker’s video had nothing to do with the pending legal action between Kueker and Buma, but just the natural subject matter that comes and goes from his channel.

He explained, as an example, that while he’s done about 20 videos on Cordova, and a significant number of videos on YouTuber Audit Them, with both men no longer being featured on his channel as they had rotated out of his natural subject lineup.

Dr. Dave added that he was currently featuring a number of Kueker-related videos. As part of his coverage, he would take the most important parts of Kueker’s videos to highlight for his audience, then break them into chunks, inserting commentary to abide by the so-called “fair use” doctrine.

He also claimed that he was not providing a market substitute for Kueker’s videos as none of his viewers would ever watch his channel instead of Kueker’s channels as they had no interest in Kueker’s channel.

After inquiring about Dr. Dave’s creative process and what software he uses to produce videos, Kueker, Cordova and Newman all individually attempted to get Dr. Dave to admit which software he used to download videos off of YouTube. He declined to respond to their inquiries.

Finally, Dr. Dave shared a Google search result with Attorney Newman which featured Attorney Robert Reed, who is being sued by both Cordova and Kueker for filling out counter DMCA requests taking responsibility for the channel owned by Frauditor Roundup.

The search revealed that Attorney Reed is connected to counterdmca.com, a website that offers YouTubers the ability to use Reed’s Law Office address for a small fee to replace their own address on a DMCA counternotice.

It also offers services where Reed would fill out the DMCA notice on behalf of the YouTuber. While the website makes it clear that users are not retaining the Law Office of Robert Reed’s services other than as a contact agent in the DMCA process.

Newman stated on the livestream that Attorney Reed had given him Frauditor Roundup’s name and information, he would not be sharing that information with anyone, including his clients.

It is unclear if further action will be taken to alert based on the revelation of the connection between Attorney Reed and counterdmca.com.

Update: The counterdmca.com link returns a “404 File Not Found” link as of Monday evening.

    And this is why this is merely a grift.
    There is a vast difference between creative content of a TV show or a movie and someone gathering content for a news story. The TV and movie are copyrighted in whole from the start. You cannot use any of it unless you are in fair use.

    A news story does not create the content but rather records it. It has much less copyright protection and only after it has been registered.

    To wit, a movie creates the scene, a news story records it. There is nothing stopping you from trying to recreate either. However, it is infinitely more likely you could record a street scene, get a cop to interview and get the same passer-bye to say the same thing. Oh and none of this is copyrightable. Whereas a TV on location clears out the old stuff, that which is normally there, say in a room they rented to film in. And their bring in props. Could you reproduce this? It is certainly possible but then you would need to get the actors to read their lines again or have someone else do it. And written words are copyrighted.

    Whereas, that cop? Government employee. Not copyrightable as he is in his official duties.

    The fact that they don’t know or see there is a difference… says so much about this lolsuit.

    It cost Kate near tell the 75K she raised to fight chilli. How much is this going to cost? More involved more time (not) so it could end up cost 100K maybe up to 300K

    Good thing DMA is selling his condo FT will have all that money to recover from when this is tossed out cause DMA’s so called lawyer is too buy attending Klan rallies and hate marches to bother to learn the cases and laws he is claiming to know.

    So potentially costing hundreds of $$$$ vs a quick and cheap settlement. Hence, its a grift, Lots of threats, insults but no law, no understanding of the law and no clear strategy either.

    This whole thing was based on the merely delusion that FT would default and thus they could get the court to award millions. insrt dr evil emoji here.

    That is not how a default works but then they would need a lawyer to explain that to them. Thus far, sadly lacking in the grift.

    FT is here, he has a lawyer and he is going to fight.

    then insist all hearings are in person
    finally set a motion that DMA’s lawyer can be held liable for any costs and bills when he loses.
    This was EVERYONE has skin in the game.

    Darcy has a proven track record of million dollar judgements. I know this to be true cause Merb checked him out and if Darcy was lying about any of his claims, Merb would have gone live on it and still be live laughing. He has not gone live and is not laughing.
    Darcy is the real deal here. He knows and he wins.
    He is on FT side.

    Remember, he does not like FT, he is a lawyer used to arguing both side of a case and he has no skin in the game. So how can he piss off the most people in his channel?

    They got an email from a lawyer, not a lawyer, just irish in sock puppet account, trolling them, But they are so clueless, and so desperate for any legitimacy they wet themselves over a real answer.

    Just like chilli, all talk, but soon the real lawyers will step in to defend themselves. Soon, the costs are going to mount and even better, safe harbour will expire…

    FYI you have a limited amount of time to withdraw a lawsuit when you realise it is more of a lolsuit then with any chance. If you drop the suit withing that time span, the other side does not get to claim legal expenses or lawyer’s bills. Once you go past that date, its all on the table.
    And them lawyers are eating someone’s condo for breakfast and his lawyer for lunch
