DMA v Frauditor Troll Drama Rages on as Dismissal Motion Looms (Corrected)

The never-ending war between Jonathan “Frauditor Troll” Huneault and Christopher “Denver Metro Audits” Cordova raged on this week as the pair traded accusations over criminal, unethical and immoral charges this week following Huneault’s filing of a response to Cordova’s response to a motion to dismiss last week.

Cordova sued Huneault last year in a contentious case that boils down to allegations of misuse of Cordova’s videos and allegations that Huneault lied about things when Cordova reported Huneault for misuse of his material.

The lawsuit itself has been a rocky road for Huneault as his attorney, “Superstar” Steven Vondran, simply forgot to include a defense for his wife, Nneka Ohiri, twice in separate motions to dismiss the lawsuit.

When Cordova’s attorney, That Randall S. “The Unhinged Attorney” Newman, Esq., filed to hold Ohiri in default after each of the errors on the part of Vondran, Huneault embarked on a public campaign against the “unethical” default. In both cases, he would later agree to comply with demands by Newman in exchange for dropping each default.

Huneault has also admitted purposedly deleting nearly 2,000 videos to prevent the use of those videos in current and in future lawsuits. However, he has produced “archival video” that survived the purge of what he says exonerates his use of Cordova’s videos.

The Canadian YouTuber’s video contains an appearance Cordova appearing on a livestream with Huneault in 2023 where Cordova allegedly granted him a perpetual license to use his content. Said video was only recently discovered, has not be authenticated and cannot be used in unauthenticated form in the litigation between the men.

To counter this, Huneault has embarked on a public campaign portraying Cordova as a convicted criminal and a “Frauditor.” Huneault has also accused Cordova and attorney Newman of conspiring to put such pressure on him and his wife that it caused a family tragedy.

Huneault outlined his allegations earlier in the week with a new video on his channel, rehashing most of his grievances with Cordova and Newman, while Cordova addressed his fans on a livestream Friday afternoon.

Cordova’s livestream opened with the Denver based terpsichorean denied Huneault’s allegations that he caused or even made fun of the tragedy that the Huneault family suffered. Though he made it clear that if Huneault faked the tragedy for fundraising purposes, he would be held in a negative light.

Huneault’s GoFundMe had made $76.00 (converted to USD) in donations on Friday, losing the daily title to our own On-Going Expenses campaign’s $100.00 take. His campaign made $1.00 in exchange rate changes on Saturday, was blank on Sunday, then came back with a $15 donation on Monday to win the day as no other campaigns that we follow received donations.

Cordova questioned Huneault’s continued use of surprise revelations to further his on-going public campaign against him. He questioned why Cordova is only bringing up his belief that he had absolute permission to use all of Cordova’s material now, and not in his DMCA Counternotices or his response to the lawsuit.

He then brought up a 2023 e-mail from Huneault in his own surprise revelation, where Huneault threatened to sue Cordova after Huneault’s main channel had been suspended from YouTube for three weeks.

He pressed home the fact that while Huneault threatened to sue Cordova for lost channel revenue in the e-mail, at no time did he bring up his belief that he had a perpetual license to use Cordova’s videos.

Cordova went on to complain about Huneault’s statements about his family not encouraging his activities as a first amendment auditor ringing true. He lumped his family into a segment of “boot lickers” that represented the general public, who do not approve of questioning the police.

He also explained that the so-called doctrine from United States v. Cordova, stemming from his criminal conviction of recording in a Social Security Administration building wasn’t the case law people believed it to be.

The YouTuber claimed that the public misunderstands the law as it does not prevent filming in the lobby of a Social Security Administration building; instead, it prevents the filming in a mixed purpose designated non-lobby area.

Promising that Cordova v. Huneault would establish more important case law, he went into an attack on Huneault for only covering his arrests and convictions, bemoaning the fact that Huneault and others never cover his acquittal or victories in court.

Cordova concluded his livestream by interacting with chat regular, Doctor Dave, who seemed offended by comments made by the YouTuber. The “good doctor” would eventually post that he was leaving as he felt he was not welcome in Cordova’s chat but has yet to follow up with an attack video featuring Cordova.

There is expected up-coming activity in the on-going lawsuit between Cordova and Huneault with an expected ruling on Huneault’s second motion to dismiss the lawsuit.

Attorney Vondran submitted a late December final response to the motion to dismiss, after Attorney Newman’s response to Vondran’s original filing again noted that the opposition left out defendant Ohiri.

The motion itself is controversial since Judge Virginia K. DeMarchi had already established that it was not time for a motion to dismiss and had canceled the hearing set for the motion to dismiss later this month. DeMarchi also indicated that she was ready to rule on what was before her, at that time, the original motion and Newman’s reply, and that implied that further responses were unnecessary.

Vondran’s response, filed two weeks after DeMarchi’s ruling, sloppily lists that hearing as the next hearing in the case despite the cancelation. It also starts by attempting to explain that everything argued in the first motion should have applied to Ohiri then clumsily restates Vondran’s case to bring an end to the back and forth on the motion.

 DeMarchi’s ruling on the motion to dismiss is expected later this month.

Correction: A previous version of this story and the audio version of the story state that it was Cordova’s channel that had been suspended for three weeks. It was, in fact, Huneault’s channel that had been suspended. We apologize for the error.
