DMA Copyright Strike Campaign Hits 1A Audits Exposé; is Dr. Dave Next?

Christopher “Denver Metro Audits” Cordova and that Randall S. “The Unhinged Attorney” Newman, Esq., joined together for another in a series of livestreams on Wednesday as they celebrated new action in their various on-going legal matters, including the issuing of a subpoena that they can serve against Google/YouTube for Doctor Dave’s information.

Cordova, who some describe looking like a baby wearing a ZZ Top beard due the smoothness of his cheeks and forehead in contrast to his lengthy rugged salt and pepper beard, announced that the pair had served 17 copyright strikes against 1A Audits Exposé and had another 12 pending.

Newman added that 1A Audits Exposé may have overreacted to their actions by pre-emptively removing videos, including those they had previously deemed fair use and would not be issuing strikes on.

Cordova added that he sent a settlement request of sorts to 1A Audits Exposé, where Cordova would back down in exchange for all the money 1A Audits Exposé made off of the videos where he violated Cordova’s copyright, which would include memberships, super chats, AdSense and sponsorships, plus attorney’s fees.

The settlement offer included all previous videos about Cordova coming down, no new videos going up, and a public admission of his abuse of fair use. Cordova later clarified that the settlement was no longer in effect as he received no answers from 1A Audits Exposé.

1A Audits Exposé, according to Social Blade, removed eight more videos from his channel on Tuesday and Wednesday, resulting in a loss of 1,813 views.

By the end of the day, the pair would file a request for a new subpoena against Google/YouTube for 1A Audits Exposé’s contact information. While the subpoena was not granted as of press time, Newman announced that he had successfully petitioned for and received the ability to subpoena YouTuber Dr. Dave on behalf of Zachary “Liberty Troll” Kueker, another of his clients.

In an early morning statement to ReallyCoolNews, Newman explained why he and Cordova are seeking a subpoena, “We’re filing a 512(h) subpoena because 1A Audits Expose is threatening to file 17 counter-notices using a “representative” to hide behind. We intend to find out who’s behind the keyboard and hold him responsible if he actually files those counters.”

Newman went on to accuse Dr. Dave of using an elderly lady from New Jersey’s contact information as part of his DMCA counter notices and indicated that he had no problem with suing the person Dr. Dave allegedly lists as the person responsible for his YouTube channels.

Neman told ReallyCoolNews, “The court has issued a 512(h) subpoena to identify the person who filed DMCA counter-notices on Dr, Douche the Racist Beer Professor’s behalf. We have strong reason to believe he used a proxy to shield his identity who never watched the videos or verified fair use. That’s a serious problem. The DMCA was designed to protect creators, not to enable anonymous copyright infringement through legal shortcuts.”

An extended discussion of Dr. Dave’s alleged racism followed, with both taking offense at Dave using the nickname “goat boy” for auditor Audit Them in reflection of his heritage.

The pair would go on to discuss the limitations of fair use, where clips of 15 to 20 seconds in length were acceptable use of Cordova’s content as long as the content was otherwise transformative.

They did not agree with an idea attributed to Frauditor Mania that playing someone’s entire video on a channel followed by a simple statement of “I disagree” would constitute fair use in any way shape or form.

Newman attempted to recruit popular first amendment auditor The First Amendment Protection Agency (FAPA), when FAPA made an appearance in the livestream’s side chat. FAPA asked for Newman’s contact information and the pair may work together in the future.

In an interesting moment, Newman brought up the idea where he’d put together an agency where creators could protect their recently created works by registering them through the agency. Works registered within three months of creation would be eligible to receive attorney’s fees on top of any judgment when defended in court.

According to Playboard.co, Cordova’s livestream on his main channel peaked at 67 concurrent viewers and received $45 in super chat donations during its broadcast. Cordova indicated that future updates on pending litigation will be featured on his Denver Metro Audits 2.0 channel and not his main account.
