Saturday’s livestream featuring Christopher “Denver Metro Audits” Cordova and Randall S. “The Unhinged Attorney” Newman, Esq, revealed more of the pair’s long-term plans as they move forward with lawsuits based on the single video that Cordova has registered along with new videos he is in the process of registering.
The duo started by making light of a recent denial of an ex parte order in Cordova’s on-going lawsuit against Jonathan “Frauditor Troll” Huneault. Newman downplayed the ruling, as while Huneault wasn’t force to restore the 1700+ videos he removed from his main channel, the Judge in the lawsuit ordered him not to destroy the videos.
Newman updated the service process in that lawsuit, stating that they sent a process server to the address listed by Huneault in his YouTube counterclaim but were unable to serve him there as Huneault did not provide a suite number in the counterclaim.
The attorney made it clear that if Huneault did not accept service by Sunday, they would go back to the Judge and show that Huneault gave them a false address and would ask for further relief.
Cordova taunted Huneault for previously saying that he had hired an attorney and would fight the lawsuit and then failing to acknowledge the lawsuit once it was filed. He pondered why if “the troll channels” were so confident in their usage of his footage as “fair use” they then removed hundreds of videos, even before he contacted the channels.
The Colorado based YouTuber said that most of the channels have refused to counterclaim in his most recent copyright strikes, opting to take the violating videos down rather than putting up a fight against his accusations.
Newman added that the change by the auditors was due to his name being listed on the claim e-mails along with Cordova. He said that when channels see his name, they know that they will be sued if they file a counterclaim and more often than not, offer no resistance and take the videos down.
Updating Cordova vs. John Doe, which concerns the Destination4Truth channel, Newman said that he tried to contact the owner of the channel but got no response to his e-mail. They filed an ex parte motion to get leave to file a subpoena against YouTube to provide the channel owner’s information.
That motion appeared in Pacer on Friday, and essentially is looking for permission to serve a subpoena on Google that may, “seek subscriber registration information, IP logs, and other identifying details sufficient to identify the individual or entity operating the YouTube channel “Destination2Truth” and any related channels using the email address La1Familiainc@gmail.com, including the channel known as “FAMILIA-TV.””
Newman then added that in another case, acting on behalf of a different channel owner, he filed a 512(h) subpoena, that would allow him access to an alleged copyright violator’s information without the need to file a lawsuit first. Randall would later release a video detailing the 512(h) process.
Through this process, a petitioner can get the name, addresses, telephone numbers, IP addresses and users associated with the YouTube channels in question. The subpoena is granted through a court clerk and does not have to go before a judge.
Cordova reminded his followers that he wasn’t out to stifle the first amendment rights of creators on YouTube but reminded them that he was there to protect his copyright. He indicated that he was in the process of registering more of his videos and that more lawsuits would follow.
He also indicated that when reviewing the use of his content, he’s deemed a small portion of the videos he’s reviewed as being “fair use” and would not be filing claims against those channels.
Cordova’s newfound popularity saw no new donations made to his on-going GoFundMe campaign for Sunday, as the market as a whole was rolling in goose eggs. The last donations made to his fund came in March of this year when he took in $105.00 in new donations. It is currently resting at $905.00 of a $20,000.00 goal.
Newman’s recent activities brought a response from YouTuber Doctor Dave, who wanted to know why Newman had a New York address when he was filing in California. He shared Newman’s LinkedIn profile and criticized Newman for claiming he went to school in Cleveland, when in fact he went to school in Akron.
Doctor Dave’s video included an AI generated rap featuring an animated photo of Newman. It is unclear if Doctor Dave video is in response to any takedown requests from Newman or Cordova, however, Doctor Dave has apparently removed a number of videos from his channel in recent weeks.
Update: Newman’s 512(h) filing was made in the Northern District of California and appeared in Pacer on Sunday. It revealed that Zachary “Liberty Troll” is seeking information about the ownership of the Frauditor Roundup channel. That channel has been active for the past two years and currently has 4,200 subscribers and 240 posted videos.
