Jose “Chille” DeCastro continued his new tradition of filing last minute motions in his on-going lawsuit against Kate Peter, Team Skeptic, Daniel Clement and Michael “Blue Bacon” Pierattini by issuing a new edict to Pierattini Tuesday night: drop all sanctions, eat all court costs, and DeCastro would never again sue him anywhere again on this set of circumstances.

DeCastro immediately dispelled any goodwill he had intended to convey towards Pierattini as he live streamed on the way back to his studio from the courthouse and disparaged Pierattini’s lawyer, R. Paul Katrinak, for forcing him to file a response to a motion that Katrinak filed on Friday.

The new filing by the diminutive YouTuber takes no responsibility for his actions in the lawsuit and blames his lack of participation in the discovery process and his inability to comply with direct orders from Judge H. Jay Ford III on his incarceration last year and a “brain fog” that had enveloped his brain since his released from incarceration until early this year.

Much like the title character Joe from the classic movie ‘Joe v. the Volcano,’ who suffered a similar “brain cloud” with dubious at best medical backing, DeCastro offered no official medical diagnosis for his condition.

He could also not explain why his previous “PTSD” claim was no longer valid, or why the length of time he was supposedly affected by the “brain cloud” had been extended. Previously, DeCastro claimed that a “good workout” after the Thanksgiving holiday in 2024 had cured him of his PTSD and resulted in the restoration of his alpha status.

DeCastro also blames Pierattini and the other defendants, as part of the so-called “Masshole Troll” mafia for forcing him into a mindset where he had previously vowed to never stop suing Pierattini despite rulings against him, He wrote:

“This quote is not evidence of bad faith. It was written during a period when Plaintiff was being actively stalked and harassed by individuals affiliated with an online group called “Troll Mafia.”

At that time:

Plaintiff’s real-time location was broadcast online; Businesses he entered were harassed with phone calls; 72 Friends, family, investors, and business associates were harassed and review-bombed on Google; Plaintiff’s car was stolen, with Troll Mafia claiming credit; Dog feces was left on Plaintiff’s doorstep and smeared on his front doorknob;

These incidents created a state of constant anxiety and justified hypervigilance. The quote reflects a trauma-fueled reaction to escalating harassment—not an intent to abuse the legal system. Plaintiff was seeking lawful relief and protection from targeted harassment and has the legal right to seek justice when legitimately harmed.”

Pierattini may note that DeCastro lost a lawsuit against the City of Ironton, Ohio, in 2023 and had the dismissal held up on appeal in 2024. During the appeal process, DeCastro filed suit against the same defendants again in Nevada, stating that he had new and compelling evidence to justify the new lawsuit.

That evidence turned into evidence he attempted to submit at a third amended complaint in the original trial, the infamous “YouTube Atomic Clock” defense, which had been previously ruled against by the Judge in the original case.

Pierattini seemed skeptical in postings on the ReallyCoolNewsWire Discord Server late Monday night and seemed to indicate that he would not be taking DeCastro’s proposed deal.

DeCastro and Katrinak are expected to square off in Thursday’s scheduled hearings in the lawsuit. The hearings include a hearing on motion to vacate or strike request for dismissal without prejudice, a hearing on motion for summary judgment, a trial setting conference and a hearing on motion for terminating sanctions.

The last-minute filing, despite DeCastro blame shifting, continues his pattern of filing motions at the last minute before scheduled hearings, resulting in another month’s delay in the case.

DeCastro has already seen over $10,000.00 in sanctions against him awarded to Pierattini, though has declined to pay sanctions at this time.

The YouTuber’s actions weren’t enough to spur great interest in his on-going GoFundMe Campaign, which took in $20.00 for the day and placed third in the Crowdsourcing standings.

SeanPaul “Long Island Audit” Reyes bested DeCastro by a wide margin, taking in $131.00 towards his Support the Fight Against Tyranny & Corruption campaign, which placed first for the day.
