A late Monday filing saw Jose “Chille” DeCastro ask for more time to serve the defendants in his lawsuit against various Judges, police officers and security guards in Clark County, Nevada, citing continued problems with a “brain fog” and PTSD as for the primary reasons for the need for an extension.

DeCastro wrote, “Plaintiff, Jose DeCastro, respectfully moves this Court for a sixty (60) day extension of time to complete service of process on all defendants pursuant to Federal Rule of Civil Procedure 4(m). This motion is made in good faith and for good cause, as Plaintiff has faced extraordinary medical, financial, and procedural hardships directly resulting from wrongful incarceration. Plaintiff seeks this extension to ensure that all defendants are properly served and that the interests of justice are preserved.”

DeCastro would go on to detail about his debilitating conditions and tremendous financial losses, which he blamed squarely on his “wrongful” incarceration: “Plaintiff was wrongfully incarcerated for four months, as detailed in the Complaint. As a direct result of this unlawful detention, Plaintiff suffered severe PTSD and persistent brain fog, which rendered him unable to function normally or organize complex legal tasks. These debilitating symptoms only began to subside around the time this lawsuit was filed, meaning Plaintiff’s cognitive capacity was severely impaired throughout most of the period when service should have been completed.

The wrongful incarceration also decimated Plaintiff’s online business, reducing YouTube viewership from over 40 million monthly views to under 2 million, and causing a revenue decline of over 90%. This financial devastation left Plaintiff with extremely limited resources to pursue this litigation and effect proper service.”

DeCastro pledged that if the court grants him a sixty-day extension, he would immediately:

  • File the necessary FOIA and public records requests to identify proper service addresses for all defendants, including John Doe parties.
  • Obtain current addresses for individual defendants and confirm service procedures for each defendant type.
  • Update all contact information as required for service and court communications.
  • Arrange for proper service through the appropriate channels for each defendant.
  • Complete service within the extended 60-day period.

Critics were quick to pounce on DeCastro’s claims as he had, on multiple occasions, declared himself “free” of both his “brain fog” and PTSD as of Thanksgiving of 2024, where he said he was “cured” of the condition following a tremendous workout.

DeCastro has also blamed his tremendous financial losses on a hack of his YouTube channel allegedly carried out by John “Irish Demon” O’Dea, for which DeCastro is currently suing O’Dea. The lawsuit is not mentioned in DeCastro’s filing.

Despite his tremendous financial hardships and brain fog, the diminutive YouTuber has made good on promises to have a working prototype of his Constitution HQ board game assembled by a self-imposed September deadline.

He has also assembled the framework for his up-coming crowd sourced bail bondsman platform, created prototypes for his new line of “press” merchandise, and established himself as a self-described nationally renowned journalist, first amendment auditor, constitutional law scholar and pillar of the community.

DeCastro showed no sign of impairment Tuesday night as he livestreamed twice from his expose on the supposed “Trump takeover” of Washington D.C., where he says that he has “exposed” the national press for “lying” about a massive police presence in the city.

The YouTuber spent most of the first livestream finding his way through the Northern end of the Nation’s Capital, encountering police and expressing his grief that he resorted to his “old ways” in an explosive police confrontation outside of a Safeway grocery store the night before.

He explained that he fully intended to file a police report on the officer involved in the incident, where he says he was pushed and chest bumped by an overly aggressive member of the Washington D.C. based police force.

Addressing his statement to the officer that he was a nationally known celebrity YouTuber, he said that he was essentially trying to make the officer back away from him and acknowledge that further escalation could bring harm to the officer based on his great fame.

Despite claiming hardship in his filing, DeCastro shared that he had two more lawsuits planned before he could sue the officer who was involved in Monday night’s incident. He then warned that he would be targeting any channel who was “big enough” to have a following with lawsuits for “slander” should they say negative things about him.

DeCastro’s second livestream saw the YouTuber and self-professed champion of the people declare that he could run a mile without a problem as he was walking to a distant traffic stop. He then began to run towards the stop, only to be heard huffing and puffing as he reached his destination.

He would spend the majority of the next hour at the traffic stop, which turned over to be related to accusations that the driver of a car stole money from a woman who was not on scene.

DeCastro walked around the active scene, maintaining a safe distance and passively engaging with the officers during the stop. He occasionally would cross the street and pretend to be talking to his phone as he shouted to “shut up” and to “stop talking to police.”

As he was passively observing, DeCastro was greeted by a neighbor who had come out to check on what was happening with the police stop. DeCastro approached the woman, who he named “Jenny,” and assured her that her identity was protected and that even if she was on camera, he was more famous than she was anyway.

The two shared some banter about the state of policing in the nation and Jenny masterfully shut down DeCastro’s rant about John Locke and the foundation of criminalization by laughing at the Constitutional Law Scholar.

When DeCastro began to question why Jenny contended that she supported those who signed up to protect and serve, DeCastro boasted that all police were in it for the money and that they had good paying jobs.

Jenny, in front of DeCastro’s camera, called his bluff, approaching one of the officers involved in the stop of the driver. She asked the man why he became a police officer and if he was making huge paycheck from job. The officer described his paycheck as miniscule and said he became a police officer to follow in the footsteps of his father, who was also involved in law enforcement.

DeCastro claimed victory as the officer stated he was following in his family’s footsteps and not to “help people,” the pair bickered for a while before DeCastro handed her one of his 5A Cop cards and told her to call him.

Jenny then took the card and threw it in a nearby trash can, eliciting a scream from DeCastro as he said the card was worth $10.00, despite him routinely handing the product out for free. She said it was creepy that he continued to try to give her his card while telling her to call him and then walked off.

DeCastro’s chat immediately picked up on details that Jenny had mentioned during her brief time on stream, including that she worked for CBS news. He then doxed her identity as one of two nationally known reporters, with that information given to him by chat. He then said that she was “drunk” and that she smelled of alcohol.

Jenny, who had simply continued her scheduled walk, returned on the way back to her apartment and the two bickered about DeCastro’s sheltered life, leading to DeCastro listing all of his life’s accomplishments in great detail.

He then confronted her with one of the two names of reporters and she laughed at him, telling him that he’d never identify her. She eventually left the scene as he was telling her that he was tremendously successful and that millions and millions of people would see her on the livestream.

Neither of the reporters that DeCastro identified as “Jenny” have made public comment on the encounter as of press time.

The man involved in the police stop was eventually released by police.

DeCastro is expected to livestream again tonight.
