DeCastro Responds to Motion to Dismiss

Jose “Chille” DeCastro filed his response to Josh Abrams’ and Kate Peter’s individual motions to dismiss in his Federal Copyright case.

The new filing essentially states that DeCastro does not have to provide examples of specific instances of copyright infringement as it will be clarified in the discovery process. He asks that the RICO standards apply to the case as he has provided sufficient evidence to claim mass copyright infringement for financial gain by the defendants.

DeCastro does ask for the Court to give him the ability to amend his complaint yet again to address weaknesses “in the interest of justice and to prevent further expense by all parties.”
