Monday was a mixed day of joy and setbacks for self-proclaimed future governor of an unnamed state and former Power Ranger Jose “Chille” DeCastro as he apparently was again late to file documents needed for his scheduling hearing later today while he continue to make significant headway into his stated $5,000.00 goal for his GoFundMe campaign.
DeCastro has a scheduling hearing set for today in his lawsuit against the Las Vegas Metro Police Department (LVMPD). At the hearing, DeCastro’s attorney, Michel Mee, and attorneys for the LVMPD are expected to receive final rulings on outstand motions and have a path established for the trial, which is scheduled for February 9, 2026.
Attorneys for the LVMPD filed multiple documents in support of their positions Monday evening, while true to recent form, DeCastro offered no new documents to support his position as of press time.
In those Documents, the LVMPD expressed concern about DeCastro, who describes himself as a self-taught “Constitutional Law Scholar” giving opinions or statements of facts about the law during his testimony.
They wrote:
“Throughout DeCastro’s criminal trial testimony and within his YouTube videos, he regularly asserts that the LVMPD Defendants violated his constitutional rights in part because he asserted his “right to be press” during the subject incident. LVMPD Defendants submit that the law does not support DeCastro’s theory that asserting one’s status as a member of the press grants special privileges or access rights beyond those available to the general public. More importantly, DeCastro is a lay witness and cannot testify regarding First Amendment standards or whether his self-described status as a member of the press has any bearing on his claims or the reasonableness of LVMPD Defendants’ actions. Resultantly, LVMPD Defendants request that the Court caution DeCastro against offering legal opinions and be prepared to rule upon objections to such testimony during the trial. DeCastro cannot comment on what the law does or does not provide for. DeCastro is unqualified to provide such testimony, and any attempts by DeCastro to influence the jury’s view of the applicable law would be unfounded and prejudicial to LVMPD Defendants.”
They previously have asked the Judge to limit DeCastro’s testimony about his conviction and acquittal of the charges and the physical injuries he claims to have suffered during the incident.
A ruling on those requests should come at the scheduling hearing.
DeCastro also received a reply from defendants Agnes Botelho and Clark County, Nevada, on Monday in his separate lawsuit against those involved in his conviction and acquittal of the charges in question in this lawsuit.
In that lawsuit, DeCastro is suing those involved in the criminal case in their personal capacities and had originally asked in upwards of $60,000,00.00 in compensation for his plight, before reducing the amount in an amended complaint.
While DeCastro has yet to serve the judge who convicted him and, inexplicably, the judge who acquitted him, defendants Clark County and Deputy District Attorney Botelho responded to the lawsuit on their own with a motion to dismiss.
DeCastro’s filing in response to that motion to dismiss came last week, a month after it was dated, and defendants Botelho and Clark County followed up with a reply on Monday.
In that reply, where they are asking judge to dismiss the charges against them, they conclude:
“Defendant Botelho is entitled to absolute immunity for traditional actions undertaken as an advocate. Plaintiff cannot point to any fact or action to demonstrate that Botelho did anything other than act as an advocate in a criminal proceeding. Any suggestion that Botelho’s actions were administrative or investigatory are improper. Additionally, Clark County is not a “person” subject to suit under 42 U.S.C. § 1983 and, even if it were, the complaint wholly fails to plausibly state a claim to relief. For these reasons, this court should grant the motion to dismiss.”
All was not bad for DeCastro on Monday, however, as his GoFundMe campaign to retain a witness consultant to prepare himself and his attorney for trial continues to gain funds towards its $5,000.00 goal.
DeCastro’s Stand with Chille, Delete Lawz, Federal Trial Feb 9, 2026 campaign won Monday with a $888.00 take. It was followed by the First Amendment Protection agency, which brought in $105.00 to the ILLEGAL ARREST DEFENSE FUND!!! And SeanPaul “Long Island Audits” Reyes, who brought in $25.00 to his Support The Fight Against Tyranny & Corruption campaign and $10.00 to his Detained for MY Rights – Continuing the Fight for OUR Rights campaign.
Tuesday saw DeCastro take the crowdsourcing title again with $1,365.00 in new donations to dominate the day. Second place went to Reyes’s Detained for MY Rights campaign, which took in $190.00 for the day.
No other campaigns that we follow saw new donations for either day.
DeCastro’s wins mark an incredible turn around for the diminutive YouTuber, who was last seen on a livestream where his GoFundMe campaign brought in less than $100.00 while he was on the air.
While DeCastro had non-GoFundMe donations during the stream, he expressed his disappointment that while he’s raised significant amounts of money for others, his fans did not come through with GoFundMe donations.
As of press time, his GoFundMe stands at $2,552.00 out of a stated $5,000.00 goal.
