


Jose “Chile” DeCastro’s petty revenge tour found willing partners this week when an attorney for defendants Josh “Accountability for All” Abrams and Dale “Lackluster” Hiller filed and appearance and a motion to extend time to respond to DeCastro’s complaint due to the pending winter holidays.
Attorney Joshua N. Garrick, who represented Abrams in DeCastro’s previous lawsuit against the YouTuber, filed appearances with the court on Tuesday indicating that he will represent both men.
The attorney also filed a motion to extend his deadline to respond to DeCastro’s complaint to January 5, 2025, which DeCastro has already agreed to. The error in the date is included in Garrick’s motion and is expected to be corrected after the Thanksgiving holiday with an updated motion.
DeCastro is suing Hiller and Abrams over a 2023 livestream in which the men allegedly defamed the diminutive YouTuber by claiming that he had a criminal history and that he was effectively duping investors in his various money-making ventures.
He is suing in Massachusetts, rather than his previous home state of Nevada or current home state of California, as Massachusetts has a three-year statute of limitations for defamation lawsuits rather than the two-year statute in those states.
Even with the forgiving statute in Massachusetts, DeCastro needed to update the dates in his lawsuit to come in under the three-year limit for filing.
This has started a pattern of last-minute lawsuits or appeals of lawsuits by the YouTuber, who has since filed a last-minute appeal of the dismissal of his California based lawsuit against YouTubers Kate Peter, Team Skeptic and Blue Bacon, and a last-minute lawsuit against “John Doe” officers in Nevada for a 2023 traffic stop where DeCastro was briefly detained.
The filing was also a surprise to most of those following the case as DeCastro has yet to file proof of service for either man. DeCastro was recently granted a second extension of his ability to serve the defendants in the lawsuit as he claimed he was having difficulty obtaining their mailing addresses. He was then given the ability to serve the defendants in the case via e-mail.
Proof of service for defendant Kate Peter, who DeCastro has targeted in two other lawsuits, has not been filed. Her status in the lawsuit is unclear at this time.
DeCastro is seeking damages of $1,000,000.00 from each defendant.
The actions to revive interest in this lawsuit did nothing to help DeCastro’s many crowd-sourcing campaigns this week as goose eggs ruled the market for Wednesday.
Thursday was dominated by the emergency of Frauditor Troll’s Help Us Fight this anti-free speech retaliation lawsuit, which took in $823.00 for the day, followed by Leonard “Leroy Truth” Filipowski’s Stand with Leroy Truth Against Injustice fund, which took in $22.00.
Friday saw Frauditor Troll’s fund win the day with a $162.00 take, followed by our own On-Going Expenses fund, which took in $150.00. Leroy Truth’s fund placed third with a $125.00 take.
