An excited Jose “Chille” DeCastro confirmed on Friday that his new social media platform would be launching on November 2, 2026, while a trio of new court filings brought a mixture of pleasure and pain to the failed Power Ranger’s immediate future.
On Thursday, his long outstanding request to modify his sur-reply to a motion to dismiss granted on Thursday in his lawsuit against Duncan, Oklahoma. DeCastro originally had filed his sur-reply over the summer to meet the deadline to file it, then almost immediately decided that he needed to modify it.
This is the famous case where DeCastro is accused of molesting three police vehicles. A separate motion to dismiss is also outstanding from the defendants in the lawsuit he has failed to serve in the 11 months since filing the suit.
In DeCastro’s lawsuit against nearly everyone who was involved in his arrest for and acquittal of charges in Las Vegas from a 2023 arrest also saw an update as Judge Ann Zimmerman, who convicted DeCastro of those charges, filed her own motion to dismiss.
DeCastro is suing the judge in her individual capacity, despite judges having absolute immunity while they’re on the bench.
Her attorney directly addressed this:
Judicial acts are entitled to immunity. See Forrester v. White, 484 U.S. 219, 227 (1988); see also Romano v. Bible, 169 F.3d 1182, 1186 (9th Cir. 1999) (noting that such immunity is “absolute”). To determine whether an act is judicial in nature, and thus entitled to immunity, this court considers whether: “(1) the precise act is a normal judicial function; (2) the events occurred in the judge’s chambers; (3) the controversy centered around a case then pending before the judge; and (4) the events at issue arose directly and immediately out of a confrontation with the judge in his or her official capacity.” Duvall v. County of Kitsap, 260 F.3d 1124, 1133 (9th Cir. 2001), as amended on denial of reh’g (Oct. 11, 2001) (quoting
Meek v. County of Riverside, 183 F.3d 962, 967 (9th Cir. 1999)). These factors are “construed generously in favor of the judge[.]” Ashelman v. Pope, 793 F.2d 1072, 1076 (9th Cir. 1986) (en banc).
“[I]t is a general principle of the highest importance to the proper administration of justice that a judicial officer, in exercising the authority vested in him, shall be free to act upon his own convictions, without apprehension of personal consequences to himself.” Bradley v. Fisher, 80 U.S. 335, 347 (1871). Because the grant of judicial immunity is so broad, “[a] judge will not be deprived of immunity because the action he took was in error, was done maliciously, or was in excess of his authority; rather, he will be subject to liability only when he has acted in the clear absence of all jurisdiction.” Stump v. Sparkman, 435 U.S. 349, 356-57 (1978) (internal citations and quotations omitted). Judicial immunity “applies even when the judge is accused of acting maliciously and corruptly[.]” Pierson v. Ray, 386 U.S. 547, 554 (1967).
Then addressed DeCastro’s claims of retaliation and his request to recover attorneys fees:
Plaintiff’s request for an injunction against further retaliation is barred by § 1983, which provides that in an action against a judicial officer for an act or omission taken in her judicial capacity, “injunctive relief shall not be granted unless a declaratory decree was violated or declaratory relief was unavailable.” ECF No. 7, P. 15; 42 U.S.C. § 1983. Plaintiff alleges neither exception. He also lacks standing to seek prospective relief because he alleges no facts showing a real and immediate threat of future injury from Judge Zimmerman. City of Los Angeles v. Lyons, 461 U.S. 95, 102, 105-06 (1983).
His request for a declaration that the defendants violated his rights concerns completed conduct and identifies no ongoing or future violation that a declaration would abate. ECF No. 7, P. 15. A declaration merely adjudicating past violations, without affecting the defendant’s conduct toward the plaintiff, is not an appropriate exercise of federal jurisdiction. Bayer v. Neiman Marcus Grp., Inc., 861 F.3d 853, 868 (9th Cir. 2017). As for fees and costs, § 1988 bars an award against a judicial officer for acts in her judicial capacity unless the challenged judicial action was clearly in excess of her jurisdiction. 42 U.S.C. § 1988(b). In any event, a non-attorney pro se litigant cannot recover § 1988 fees. Gonzalez v. Kangas, 814 F.2d 1411, 1412 (9th Cir. 1987).
It concluded:
Judge Zimmerman is entitled to absolute judicial immunity for each of the alleged acts made in the operative complaint. For this reason, this Court should grant Judge Zimmerman’s motion and dismiss all claims against her in the First Amended Complaint (ECF No. 7). The damages claims should be dismissed with prejudice and without leave to amend, and the remaining requests for relief should be dismissed.
That lawsuit received a second update on Friday, with a ruling by Magistrate Judge Brenda Weksler:
MINUTE ORDER IN CHAMBERS of the Honorable Magistrate Judge Brenda Weksler on 10/30/2026. Before this Court is Defendant Judge Zimmerman’s motion to extend time to respond to Plaintiff’s complaint. ECF No. 42. As Defendant Judge Zimmerman has filed a responsive pleading (her motion to dismiss at ECF No. 44), the motion to extend time (ECF No. 42) is denied as moot.
The diminutive YouTuber also livestreamed Friday morning where he attempted to explain the platform for his Reconstitution political party:
As you guys know, the governor’s handbook’s coming out, the new channel Reconstitution is coming out. So just a little bit more just a tiny bit more. I’m really gonna start November 2nd.
I’m gonna release the first video November 2nd so you can look forward to that and the new channel coming out then and we’ll be on all networks TikTok. I’m going back on TikTok So I I’ve had five million subscribers deleted from TikTok. So I’m not in a hurry to to rebuild TikTok, but I’m going to.
Later adding:
The idea is simple. America is fundamentally broken, and to fix it, we have to fix the Constitution and give it back to the people It’s independent
because neither party is going to take on the police unions, the multinational corporations, or the super PACs that fund them both That’s why this movement refuses corporate and super PAC money and is built on members, regular people. Every chapter of the handbook is a promise, and every candidate who runs under reconstitution runs on that book. One correction, Governor. I was wrong a minute ago when I said I couldn’t reach your email. I can save that to-do list as a draft in your Gmail if you want.
Go ahead, let’s do that. The Reconstitution Party, because we don’t trust Democrats and we don’t trust Republicans. I call them dumb publicans and retardicans.
As long as there is this broken two-party system that is ran and funded by the Epstein Billionaire class, you and I will never be free. As long as they can create caveats in all of our rights with unelected judges, and then the Fed or the state legislatures don’t do anything to overcome it, we do not have freedom in this country. You can’t go outside and walk down the street without cops being able to grab you, put you on your knees, tell you to get on your knees, get on your belly.
They get to put their knees in your back and in your neck. They get to put you in chains and put you in a cage And you’re not arrested, your rights have not been violated. You’re only being detained.
That’s some fucked up shit right there. And it has to change That’s the reason I’ve spent so many months and months and months writing the governor’s handbook, laying out an exact map of how we change this shit. It’s taken me all my time.
I’ve had to lean on team DLZ. Hey, DLZ Dono, DLZ, like help me, right? Because I need your help.
I’m not sitting on my thumbs doing f<unk>ing nothing, I guarantee you that. I’ve written 72 chapters of a book that lays out a new political party, a new direction. Because we cannot go with retardicans and dumb publicans anymore.
Neither side can be trusted. How do you know that? Because you got the Democrat who’s a Democratic Socialist running in Michigan against Mike Rogers, who’s a Faithful MAGA loyalist, both of them are fed up.
I mean the fact that Abdul isn’t 30 points ahead of Mike Rogers is disgusting. Because the people on the right won’t trust the guy on the left. And the people on the left won’t trust the guy on the right.
We need a centrist party that’s about our constitutional rights. First, about America first, really. Not I’m gonna protect the Epstein class and go bomb a bunch of countries and maybe drop a nuclear bomb on Iran so that I can stay in power.
Because Trump is f the moment he’s out of power, he’s gonna get prosecuted for being a rapist. I believe he’s a pedophile. All with all my heart.
And so is Bill Clinton. They’re both pedophiles. I believe it with all my heart.
And it’s being hidden from us. And those are two of the most popular presidents in U. S. history and their pedophiles, as far as I’m concerned. I believe it with all that I am.
So I’m not gonna stop. I’m not gonna quit. That’s why I’ve been asking you guys to help me.
DeCastro’s last remaining GoFundMe campaign, a fundraiser for Heather Chandler from Duncan, Oklahoma, has not seen new donations based on DeCastro’s continued presence on social media.
Friday saw the newly formed GoFundMe by David “Dr. Dave” Coulter take the day with $350.00 in new donations to the campaign to fight what he says is false claims and a harassment campaign by Shade George ‘Audit Them’ Ghanayem.
Aidan “Turtleboy” Kearney and SeanPaul “Long Island Audit” Reyes tied for second place with each man receiving $5.00 in new donations.
Saturday saw Kearney take the top spot with $245.00 in new donations, edging out Coulter’s new campaign for first place with Coulter’s campaign taking in $204.00 for the day.
Central Tyrant Investigations’ Justice for Unlawful arrest in Pudach fund placed third with $5.00 in new donations.
No other campaigns that we follow saw donations for the day.
DeCastro has announced that the Reconstitution party’s social media presence will start on November 2, 2026.
