Michael “Blue Bacon” Pierattini’s (Bacon) lawyer, R. Paul Katrinak, filed his response last week to Jose “Chille” DeCastro’s first amended complaint in his California based lawsuit against Bacon, Team Skeptic, Kate Peter and Daniel Clement.
The response denies every allegation made by DeCastro and denies that DeCastro sustained or will sustained any damages in the sums alleged. It also denies that DeCastro suffered any injuries, damages or losses by any act, omission, break, or statement on the part of Bacon.
Katrinak’s affirmative defenses question why DeCastro has focused on Bacon in the lawsuit when the vast majority of the charges involve the other defendants. The other defendants in the case have yet to
The defense also questioned why DeCastro has failed to produce discovery requests at the time of the filing that would have helped understand why he claims all of the charges are the sole responsibility of Bacon.
Other key affirmative defenses surround a First Amendment defense as DeCastro has brought charges based on words allegedly spoken by the defense on the internet. Katrinak contended that those specific incidents were protected by the First Amendment, if true, and caused DeCastro no actual damage.
Katrinak’s response ends by asking for the dismissal of DeCastro’s first amended complaint with prejudice and/or a judgement in favor of Bacon, costs incurred, statutory damages as permitted by law. And any other relief the Court deems just and proper.
