DeCastro Files Second Motion for Contempt Against Kate Peter

Jose “Chille” DeCastro filed a second motion for contempt against Kate Peter in his federal copyright lawsuit on Monday, January 16, 2023.

DeCastro’s filing claims that when Peter reviewed his site, endtorturecuffs.com, on her January 11, 2023, live stream, she knew the site was still in “coming soon” form and she knew that the stories and pictures presented on the site were simply placeholders. He claimed that by reviewing the site, Peter damaged his reputation and cost him future revenue and violated the court’s order not to disparage anyone involved in the case when Peter made statements calling DeCastro a liar.

Continuing, DeCastro made revenue of over $100,000 alone from her “trolling endeavors,” credits himself for ignoring her statements and refusing to retaliate against her and blames Peter’s alleged illegal activities for forcing him to file litigation against her.

DeCastro’s site has been confirmed to have been indexed as a live site by the Bing search engine and bore no markings of “coming soon” or “beta” when Peter reviewed it. While sites that are in beta or “coming soon” form usually do use placeholders for text and images, the placeholder text is more often than not written in Latin gibberish and the placeholder images have no relation to the site and are not published to the web.

For example, the site you are reading, ReallyCoolSite.org, does not have a dedicated private test server, but when the articles are being written they are held on the site in an unpublished state where they are not available for public access, nor are they indexed by Bing, Google or any other indexing robots. If the public were to see examples of our placeholder articles, they’d see blank placeholder images and a lot of Latin gibberish. See example below.

DeCastro claimed that he had no involvement in the creation of his website and is not at fault for the site appearing prematurely in search engines.

He is not seeking damages or punishment for Peter in his motion, just a generic statement that she be held in contempt.
