Jose “Chille” DeCastro found himself in an unfamiliar place on Thursday as his appeal of his long-standing California Superior Court case against Michael “Blue Bacon” Pierattini, Team Skeptic and Daniel Clement was denied and he continues to seek an extension to file his opening remarks in his appeal of his recent Federal loss to the Las Vegas Metropolitan Police Department.

Starting with the California case, DeCastro originally filed the case against the three defendants named in the appeal along with Kate Peter in early 2023. It was essentially a rehash of his 2022 suit against Peter and Josh Abrams from a Federal case that DeCastro would morph into copyright litigation against YouTube, Peter and Abrams.

DeCastro blamed the quartet for a series of harassing incidents that he claimed happened over the spring and summer of 2022. The events included having his van stolen, having threatening signs and Nutella put on the door of an Airbnb he was staying at and other acts of harassment where he was supposedly tracked like a great white shark by Peter’s supporters.

The lawsuit itself went largely nowhere for two years and was hampered by DeCastro’s lack of participation in the suit and his time spent in jail in Las Vegas due to DeCastro’s conviction and then acquittal of 2023 charges of interference in a traffic stop and obstruction of an officer when he went to trial in 2024.

Due to DeCastro’s lack of participation in the case and multiple purposeful attempts to hinder the discovery process and ignoring directives by the judge, DeCastro was eventually assessed over $15,000.00 in sanctions by the court.

DeCastro himself decided to voluntarily end the lawsuit against defendants Clement, Skeptic and Pierattini in the Spring of 2025, without prejudice, as he wanted to reserve the right to sue the defendants in the future.

Pierattini objected to the without prejudice condition of the dismissal and asked the judge to dismiss the case with prejudice based on DeCastro’s actions that resulted in terminating sanctions.

The judge in the case granted DeCastro’s motion to dismiss the case without prejudice against Skeptic and Clement, while siding with Pierattini and granting the terminating sanctions to dismiss the case against Pierattini with prejudice.

Defendant Kate Peter remained unaffected by any of this as the Clerk’s finding that she was in default was never litigated.

DeCastro took the ruling in stride until he changed his mind and appealed the Judge’s ruling, hoping to undo his own decision to drop the case against Skeptic and Clement while objecting to the Judge’s decision on Pierattini.

While DeCastro filed the appeal in November of last year, it did not appear on the 2nd Appellate District’s register until April of this year. A notice of default under rule 8.100(c) was issued soon after noting that DeCastro had not paid a $100.00 fee to the superior court clerk.

The Court issued a second warning last week, and the case was ultimately dismissed on Thursday following DeCastro’s apparent nonpayment. It is unclear at this time whether DeCastro can appeal the decision to dismiss his appeal.

In his federal appeal of his recent loss to the Las Vegas Metropolitan Police Department, DeCastro’s attorney, Michel Mee, filed an extension to delay his opening brief until mid-July of this year.

A prior extension had been granted due to the parties entering into mediation. That mediation was cancelled last month following DeCastro’s attempts to livestream the otherwise confidential mediation sessions.

No reasoning was given for the current request to delay.

DeCastro’s GoFundMe campaigns saw no action for either Thursday or Friday.

Angel “Kansas City Accountability” Moses won Thursday with $110.00 in new donations to his Justice for Unlawful Arrest in Ohio fund. He was followed by Roy Tripoloni’s fund for James “James Freeman” Springer, which brought in $70.00.

For Friday, Tripoloni’s fund regained the top slot with $220.00 in new donations. Our own On-Going Expenses campaign placed second, with $125.00 in new donations. SeanPaul “Long Island Audits” Reyes placed third with $20.00 in donations to his Support The Fight Against Tyranny & Corruption fund, and Angel Moses placed fourth with $15.00 in new donations to his campaign.

No other campaigns that we follow saw donations for either day.
