YouTuber Jose “Chille” DeCastro’s second day of his trial against the Las Vegas Metro Police Force (LVMPD) moved quickly on Tuesday with three more of the police officers who were involved in his arrest taking the stand as hostile witnesses.
DeCastro followed the day with a brief statement on his Instagram live that everything you say can and will be used against you in court, including the things he said while he was at trial.
In the video, he bitterly complained that when officer Jesse Sandoval was asked about if he remembered being told by DeCastro that he was squeezing his arm too tightly, Sandoval responded that he remembered DeCastro telling him to “suck his dick.”
The diminutive YouTuber said that the admission by Sandoval sent shockwaves through the courtroom and alluded to the fact that it was followed by similar responses by Sandoval and officer Clinton Doolittle, who followed Sandoval.
He expressed concern that the jury and spectators in the courtroom did not understand that it was his First Amendment right to insult, degrade and ask the officers on scene to perform sexual activities and that his statements were being weaponized against him.
While he admitted that his attorney was prepared for the defense shifting the focus from the testimony of the officers to the statements made by DeCastro on the scene, he seemed concerned as to their impact on the jury.
Strangely, DeCastro made no mention of the testimony of arresting officer Branden Borque, who was the first witness to testify on Tuesday. In Monday’s statement, DeCastro highlighted inconsistencies in Borque’s statement that DeCastro did not back up, when DeCastro clearly took a small step backwards on the video footage of the event.
The inventor of the “Jock Sock” had previously made mention of this fact as it proved to be key in his acquittal of his 2024 conviction of the charges that came from the 2023 incident at the heart of the case.
With Sgt. Torrey testifying on Monday and officers Borque, Dolittle and Sandoval testifying on Tuesday, officers Dingle and Sorenson remain to be called as hostile witnesses on Wednesday, along with DeCastro, who bears the burden of proving his case.
DeCastro is seeking $1,000,000.00 for injuries to his Ulnar nerve and his testicles during the event. He has provided no evidence or expert witnesses to back his claims. In pretrial filings, DeCastro stated that he would be able to testify to the pain and suffering he experienced since the incident.
The YouTuber also recently revealed on a livestream that he had seen a doctor who indicated that there was no lasting damage to his Ulnar nerve and presumably, the $5,000.00 in estimated surgical costs to repair his nerve, as listed by DeCastro as a projected expense, would not be needed.
Once DeCastro’s testimony concludes, the defense has listed DeCastro, along with Sgt. Torrey and officers Borque, Dingle, Sorenson, Sandoval and Doolittle as witnesses. It is unclear based on DeCastro’s account of the first two days of testimony, if the defense will re-present the witnesses or if it will rest based on the testimony the jury has heard so far.
