A surprise filing posted on Monday, December 1, 2025, by attorney Josh Garick, representing defendant Josh Abrams, moved to have Jose “Chille” DeCastro’s one-million-dollar lawsuit from the court of Judge Leo Theodore Sorokin to the court of Judge Allison D. Burroughs.
If that name sounds familiar, Judge Allison D. Burroughs was the judge assigned to DeCastro’s 2022 attempt to sue Abrams and Kate Peter in a lawsuit, that at least at first was nearly identical to the one that DeCastro filed against Abrams earlier this year.
DeCastro, in both lawsuits, is angry over comments Abrams and Kate Peter, now joined by Dale “Lackluster” Hiller, made against him during a livestream in 2022. The diminutive YouTuber claims that the trio did such damage to his reputation that he needed to be handled one million dollars.
Ignore the fact that DeCastro has two other current lawsuits claiming that he needs boat loads of money to make up for the separate destructions of his channel in 2024, or that his channel has actually gained 500,000 followers since the 2022 livestream in question.
He believes that it is Abrams and Peter and Hiller who are to blame for his apparent misfortune so much so that DeCastro revived his original complaints against two of the three, which apparently gives Garrick his in to have the case transferred to Burroughs’s courtroom.
According to Garrick, under the Court’s local rules, civil cases are related if some or all of the parties are the same and if one or more similarities exist. In this lawsuit, the main defendants are the same, with the addition of Hiller, it came from the same incident, and DeCastro is arguing the same facts.
DeCastro may oppose the reassignment as he and Burroughs had an acrimonious relationship at best during the extended trial. Long time fans remember a famous incident where DeCastro apparently became so obsessed with his supposed mistreatment by Burroughs that he lashed out at a sock account who appeared in DeCastro’s side chat during a livestream.
The YouTuber attacked the screen name, convinced that Judge Burroughs was actually in his side chat. He further claimed that she was watching all of his videos and that her viewership was impacting the lawsuit as she was obviously biased against him.
That lawsuit, which had morphed into a copyright lawsuit against Peter, Abrams and YouTube, was eventually dismissed without prejudice in 2023. Peter and Abrams counterclaims were also dismissed without prejudice.
A possible transfer to Burroughs’s court may also be problematic for defendant Kate Peter, should she chose to take part in the lawsuit. In the first lawsuit, Peter had an antagonistic relationship with DeCastro, resulting in she and DeCastro trading claims of contempt of court.
All of the contempt claims were denied by Judge Burroughs, though both parties were strongly warned as a result of their actions. It is unlikely that such antics would be tolerated again should either side repeat the behavior.
Judge Sorokin responded to the request by issuing the following electronic order:

By December 8, 2025, Plaintiff shall respond to the Motion of Defendant Abrams asserting that this case is related under the Local Rules of this Court to a prior case filed by DeCastro (22cv11421-ADB).
